INTERLOCAL AGREEMENT <br />between <br />INDIAN RIVER COUNTY, FLORIDA <br />and <br />CITY OF SEBASTIAN, FLORIDA <br />This Interlocal Agreement, entered into this I qL,, clay, 1999, by <br />and between INDIAN RIVER COUNTY, FLORIDA, a politicalAsubdion of the state <br />of Florida, hereinafter referred to as COUNTY, and the CITY OF SEBASTIAN, <br />FLORIDA, a municipal corporation of the State of Florida, hereinafter referred to as <br />CITY, for the purpose of utility relocations, provides: <br />WITNESSETH: <br />WHEREAS, the COUNTY and CITY agree that utilities owned by the COUNTY <br />are located in the CITY Right of Way along Schumann Drive; and <br />WHEREAS, the COUNTY accepts responsibility to relocate these facilities when <br />in conflict with CITY facilities; and <br />WHEREAS, the CITY intends to install storm drain facilities that require <br />relocation of the utilities owned by the COUNTY; and <br />WHEREAS, the COUNTY can benefit from having the CITY contractor relocate <br />said facilities during storm drain construction; and <br />WHEREAS, an undertaking of this nature is in kccping with the "Florida <br />Interlocal Cooperation Act of 1969" as set forth in Florida Statutes Chapter 163; <br />NOW, THEREFORE, in consideration of the mutual teens, conditions, promises, <br />covenants and premises hereinafter set forth and pursuant to the statutory authority <br />contained in F. S. Chapter 163, the COUNTY and CITY agree as follows: <br />I . The COUNTY authorizes the CITY construction contractor to relocate COUNTY <br />water and wastewater utilities along Schumann Drive that conflict with new storm <br />drain pipes to an acceptable location, and CITY agrces to include said work in its <br />contract for the Schumann Drive Project. <br />2. Within forty Five (45) days of invoice by CITY, the COUNTY agrees to reimburse <br />the CITY contractor's bid price of $82,250 for said utility relocation on the basis of <br />work completed, accepted by the County and paid for, plus any additional costs <br />approved by the COUNTY as necessary and legitimate changes, or for which the <br />CITY is ultimately found liable due to the utility relocation portions of the contract, <br />that may be arise. <br />RECEIVED <br />JUL 2 2 1999 <br />CLERK TO THE BOARD <br />
