<br />DESIGN/BUILD CONTRACT - PART 2 AGREEMENT
<br />AMENDMENT #1- FINAL DESIGN, PERMITTING AND CONSTRUCTION
<br />SECTION I - GENERAL
<br />THIS AMENDMENT 01 (also referred to as Part II Agreement), entered into this A --ay
<br />of , 1999, by and between INDIAN RIVER COUNTY, a Political subdivision of the
<br />State of Florida, 1840 25th Street, Vero Beach, FL. 32960, hereinafter referred to as the COUNTY,
<br />and BARTH CONSTRUCTION, INC., 1717 Indian River Boulevard, Suite 202 A, Vero Beach,
<br />FL.32960, hereinafter referred to as the DESIGNBUILDER„ further describes the Scope of Work,
<br />guaranteed maximum cost, and schedule for designibuiId services which were previously included
<br />in the DESIGN/BUILD Contract dated January 5, 1999. This amendment complements and adds
<br />to the original agreement.
<br />SECTION II - SCOPE OF WORK
<br />The DESIGN/BUILDER shall provide final professional architectural design, engineering,
<br />construction, permitting, inspection, and all related services to the COUNTY for the INDIAN
<br />RIVER COUNTY FAIRGROUNDS AGRICULTURAL ARENA/EXHIBIT BUILDING located
<br />at the Indian River County Fairgrounds site, 7965 581 Avenue, as defined in the attached "Indian
<br />River County Agricultural AremdExhibit Building Scope of Work by Phase and General
<br />Specifications," including engineering and architectural preliminary plans, labeled Exhibit #i dated
<br />May 6, 1999 as prepared by Barth Construction, Inc., Carter and Associates (sheets C-1 tluu C-4),
<br />Edlund and Dritenbas Architects(shcets A-1 thru A-4 and ME -1), and Proposal dated June 4, 1999.
<br />Exhibit #1 is hereby made a part of this Amendment.
<br />SECTION III - MAXIMUM GUARANTEED COST
<br />The DESIGN/BUILDER shall perform all final architectural and engineering design,
<br />drawings, preparation of material specification, meetings, permitting, utility coordination, building
<br />construction, and all required services to deliver complete building, read for use, for a maximum
<br />guaranteed cost of $ 1,007,854 as detailed on the "Proposal" dated June 4, 1999 included in Exhibit
<br />#I. In addition to the building and site work construction cost, this guaranteed price includes
<br />architectural and engineering design for the 20,000 s.f. building and site work plans, meetings,
<br />construction observation, permit fees, material testing for building and site work, removing of any
<br />existing facilities within the construction schedule time frame as described in the "Proposal', Exhibit
<br />#1. The COUNTY is responsible for site work to only include demolition, clearing, Ell, compaction,
<br />drainage, irrigation, and landscaping.
<br />SECTION IV - PROJECT SCHEDULE
<br />The project schedule shall be as follows commencing on issuance of a Noticc-to-Proceed
<br />from the County:
<br />Final Design and Permitting 90 Calendar Days
<br />Construction 180 Calendar Days
