She pointed out that the State County entities are required to participate in <br />the Florida Retirement System (FRS). Ms. Boyll stated that a portion of the <br />County workforce had been deemed ineligible due to already having earned a <br />retirement benefit from the FRS through a prior career. The proposed Ordinance <br />amendment would allow the County to offer a retirement benefit under a defined <br />contribution plan at no additional cost to the County and allow the County to <br />provide a retirement benefit to those deemed ineligible under the FRS. <br />County Administrator John Titkanich stated that the amendment would aid in <br />attracting potential employees who had retired from the FRS. He believed that <br />offering this benefit to all employees was a matter of fairness and equity. <br />Chairman Earman sought clarification from County Attorney Dylan Reingold for <br />transparency and stated that the Ordinance could affect some members of the <br />Board in regard to participation. Attorney Reingold stated that what was <br />presented today was not automatic, and staff could opt out. He stated he had <br />researched what other Jurisdictions and Commissioners had done and personally <br />did not believe this was an issue of additional compensation under this statute. <br />Chairman Earman stated it would benefit the County to recruit employees and <br />attract retirees to join the workforce. Attorney Reingold stated that the Clerk had <br />no opposition to the plan and supported the program. <br />Additional discussion was had between the Board and staff regarding <br />participation and the opportunity to offer retirement benefits to current and future <br />employees. <br />The Chairman opened the public hearing for comments. There being none, the <br />Chairman closed the public hearing. <br />A motion was made by Commissioner Moss, seconded by Commissioner <br />Loar, to adopt Ordinance 2023-009, amending Section 104.03 (Retirement <br />System) and creation of Section 104.03.1 (Defined Contribution Plan) of <br />Chapter 104 (Human Resources) to modify the County Retirement Benefits; <br />and providing for codification, severability, repeal of conflicting provisions; <br />and an effective date.
