Fp�- -7 <br />BOOK 4, 657 <br />It is recommended that the Board adopted the attached Resolution which <br />would authorize condemnation of this one acre parcel. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously adopted <br />Resolution 96-75 declaring the acquisition for <br />drainage related to road right of way of a parcel on <br />the west side of 58th Avenue (Kings Highway). <br />RESOLUTION NO. 96- 75 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, DECLARING THE ACQUISITION FOR <br />DRAINAGE RELATED TO ROAD RIGHT OF WAY <br />OF A PARCEL ON THE WEST SIDE OF 58TH <br />AVENUE (KINGS HIGHWAY), COUNTY PROJECT <br />#8823, INDIAN RIVER COUNTY, FLORIDA, TO BE <br />A PUBLIC PURPOSE AND A PUBLIC NECESSITY; <br />AND AUTHORIZING THE ACQUISITION OF SAID <br />PARCEL BY DONATION, PURCHASE, OR <br />EMINENT DOMAIN. <br />WHEREAS, the safe, efficient and uninterrupted transportation of <br />people and property from place to place on the County Road System <br />of Indian River County is a matter of great concern to the people of <br />the County; and <br />WHEREAS, the elimination of safety hazards in existing and <br />future transportation facilities within Indian River County is of utmost <br />concern; and <br />WHEREAS, it is beneficial and desirable that vehicular traffic <br />Within any transportation facility in developed or developing areas of <br />the County has an adequate right-of-way to accommodate the roadway <br />and its appurtenant facilities to decrease the likelihood of accidents <br />and to increase the safety of travel within and upon such facilities; <br />and <br />WHEREAS, the County is in the process of completing the <br />engineering design for the widening of 58th Avenue between Oslo <br />Road and just north of 26th Street; and <br />WHEREAS, the existing right-of-way of said road is inadequate <br />for proper utilization by vehicular traffic volumes and requires <br />additional traffic lanes and improved drainage facilities to reduce <br />safety hazards and improve traffic flow; and <br />WHEREAS, in order to construct a safe road the County has <br />acquired additional right of way on the west side of the existing road <br />right of way as needed, except for the property described in <br />Resolution 96-64; and <br />JULY 2, 1996 14 <br />
