AGREEMEN i <br />Fel ixAgrS10TN'r(bit) <br />THIS AGRFEMENT, made and entered into this 21 day of _-, 1999, <br />by and between. Felix Equities, Inc., 5100 291° Court, Vero Beach, Florida 32967, hereinafter called <br />the CONTRACTOR, and Indian River County herein called the OWNER. <br />WITNESSED: That whereas, the OWNER and the CONTRACTOR for the consideration hereinafter <br />named, agree as set forth below: <br />Article I Scope <br />The scope of work shall include, but not be limited to furnishing all required labor, materials, <br />supervision, equipment, tools, insurance, taxes, permits and all other items to provide additional depth <br />Of 106 ®m of Asphltdk Bax, which also includes the cost for additional excavation and Maintenance <br />of Traffic, on Florida Department of Trivisportation (FDOT) State Job Number: 88000-3605 located <br />on CR 510 (85` Street). <br />The CONTRACTOR, as a independent contractor and not as an employee, shall funush the above <br />described work for the estimated price of $71,500.00, which is based on 5032 square meters at <br />$14.21 per square meter. The final quantity will be field measured and the total square meters as <br />agreed w171 be invoiced at $14.21 per square meter. <br />Article II. General: <br />The CONTRACTOR hereby certifies that he has examined the location of the proposed work <br />as is necessary to understand fully the nature of the obligation herein made; <br />All work under this CONTRACT shall be done to the satisfaction of the OWNER, who shall <br />in all cases determine the amount, quality, fitness, and acceptability of the work and materials which <br />are to be paid fbr thereunder, and shall decide all questions which may arise as to fulfillment of the <br />AGREEMENT on the part of the CONTRACTOR, and his decision thereon shall be final and <br />conclusive; and such determination and decision, in case any question shall arise, shall be a condition <br />precedent to the right of the CONTRACTOR to receive any money thereunder. <br />Any clause or section of this AGREEMENT or specification which may for any reason be <br />declared inv9d, may be eliminated therefrom; and the intent of this AGREEMENT and the remaining <br />portion thereof will remain in filll force arid effect L-uw <br />..... as tuiui such invaiiri riatga 0; �-()j <br />- <br />been <br />�-- <br />uaa uul <br />been incorporated therein. <br />Article 111 Quantities and Prices: <br />The OWNER shall pay the CONTRACTOR for all work included and completed in <br />accordance with this AGREEMENT, based on a unit price of $14.21 per square meter. <br />
