Vitunac, ount Attorney Y DATE: July 1, 1996 RE: Public Hearing - Sebastian Area MSBU Water and Sewer Line Extension Ordinance The attached ordinance is required under state law for a county to levy special assessments within a municipality. This ordinance would allow the County to levy assessments for water and sewer line extensions within the City of Sebastian. The City has adopted an ordinance approving of such a district. Recommendation: Staff recommends adoption of this ordinance so that utility services can be provided. by assessment to the City of Sebastian. Vice Chairman Eggert opened the public hearing and asked if anyone wished to be heard in this matter. There being none, she closed the public hearing. ON MOTION by Commissioner Macht, SECONDED by Commissioner Tippin, the Board unanimously adopted Ordinance No. 96-13 creating a municipal services benefit unit for the City of Sebastian; authorizing the levy of special assessments to fund water and sewer line extensions. ORDINANCE NO. 96- 13 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, CREATING A MUNICIPAL SERVICES BENEFIT UNIT FOR THE CITY OF SEBASTIAN; AUTHORIZING THE LEVY OF SPECIAL ASSESSMENTS TO FUND WATER AND SEWER LINE EXTENSIONS. WHEREAS, by interlocal agreement between the City of Sebastian and Indian River County, the Indian River County Department of Utility Services is authorized to provide water and sewer services to the City of -Sebastian; and WHEREAS, as part of that interlocal agreement, the City and County agreed that certain areas of the City would be provided water and sewer line extensions to be paid for by special assessment against the benefited properties; and - WHEREAS, the agreement indicated that if the City chose not to hold these special assessment hearings itself that the City would authorize the County to hold such hearings; and 16 July 9, 1996
