As per county code requirements, the owners of the properties were issued notices to <br />repair or remove the structures, and advised of their right to appeal the condemnation <br />order before the Indian River County Building Code Board of Adjustments and Appeals. <br />In addition, condemnation cards were posted on the properties. Because staff could not <br />obtain legal service for the condemnation notice on the property owned by Curtis Lee <br />Brown, Sr. (#2 on attached list), and property -owned by Eddie R. Jordan (#7 on <br />attached list) , a public notice was posted at the Indian River County Courthouse. <br />ANALYSIS: <br />The subject structures have been vacant for a considerable time. During that time, the <br />buildings have continued to deteriorate and have been frequented by vandals and <br />transients. Not only have the owners failed to maintain the structures in compliance with <br />the Minimum Standard Codes, they have failed to bring the structures into compliance as <br />required by posted notice. Since the owners have not filed an appeal to the condemnation <br />order, the county may now proceed with demolition of the structures. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners declare said structures a <br />nuisance, and order the buildings demolished with related debris removed from the <br />property. This would be done by awarding a contract to a private company selected <br />through standard procurement practices. <br />Staff further recommends that the Board adopt the attached resolution authorizing the <br />Building Official to report the county's demolition and debris removal cost for each <br />structure to the county attorney for the preparation and recording of a lien to be placed <br />on the real property of the owner of each demolished unsafe structure for the purpose <br />of recovering the county's costs. <br />Director Rymer offered to explain each building individually, <br />whereupon Vice Chairman Eggert asked if there was anyone present to <br />challenge action on any of the structures. There was no response. <br />Commissioner Macht inquired if there was an environmental <br />assessment on any of the properties, and Director Rymer replied <br />they were all single family homes. <br />Commissioner Macht asked if there was any history of possible <br />environmental problems, and Director Rymer responded she was not <br />aware of any. <br />MOTION WAS MADE by Commissioner Bird, SECONDED by <br />Commissioner Tippin, to adopt Resolution No. 96-76 <br />providing for demolition of unsafe structures and <br />recovery of costs on properties set forth on <br />Addendum "A", as recommended by staff. <br />Under discussion, Commissioner Bird voiced concern about <br />removal of LP gas tanks, and Director Rymer advised that tanks <br />would be disconnected by the gas company and removed. <br />THE CHAIRMAN CALLED THE QUESTION and the motion <br />carried unanimously. <br />19 BOOK98 <br />P$�.r, <br />July 9, 1996 <br />
