B. if the Contractor shall assign this Contract or any money accruing thereon or approval thereon, or abandon the work or is adjudged a bankrupt, or if he makes a general assignment for the benefit of his creditors, or if a trustee or receiver is appointed for the contractor or for any of his property, or if he shall refuse or neglect to comply with the instructions of the Owner or Engineer relative thereto, or shall in any manner failt to comply with the Specifications and stipulations herein contained, The Owner shall have the right to annul and cancel this Contract and proceed to advertise and re -let a contract for the unfinished work, and such annulment shall not entitle the Contractor to any claim for damages on account thereof, nor shall it affect the right of the Owner to recover damages on account of such failure. 24. PROTECTION OF PUBLIC A. The Contractor shall erect and maintain barricades and sufficient safeguards around all excavation, embankments or obstructions; he shall place sufficient amber lights at or near the work, keep the same burning from sunset to sunrise, employ watchmen and i strictly obey all laws and ordinances controlling or limiting those engaged on similar work. All maintenance of traffic work shall comply with Section 102 and Special Provision Item 102-1 of the Florida Department of Transportation. Standard p ifi atiors £Qr Rnad and Bridee ConstructiQn I B. Where there are telephone, telegraph, light, or power poles, water main, conduits, pipe, or drains; or other construction either public or private, in or on the streets or alleys; the work shall be so conducted that no interruption or delay will be caused in the operation or use of the same. Proper written notice shall be given and all the facilities afforded the owners of such construction encountered or likely to be encountered, as will enable them to preserve the same from injury. C. The Contractor will not be permitted to interfere with public travel and convenience by grading or tearing up streets indiscriminately, but the work of conducting the various items of this Contract shall proceed in an orderly, systematic and progressive manner. 25. PUBLIC ENTITY CRIMES: The Contractor shall complete, and execute in the presence of a notary, or other officer authorized to administer oaths, the sworn statement under Section 287.133(3)( a)F.S., Form PEC -1 of this contract. 26. DIS.CLQSURE OF RELATIONSHIPS The Contractor shall complete, and execute in the presence of a notary, or other officer authorized to administer oaths, the sworn statement under Section 105.08, Indian River County Code, Form DOR-I of this contract.
