utilize any substitution wilf'rout either an exw3ted Change Order or Engineers notation on <br />the reviewed shop drawing, OWNER may require CONTRACTOR to furnish at <br />CONTRACTOR'S expense a special manufacturer's performance guarantee(s) or other <br />surely with respect to any substitute and an indemnification by the CONTRACTOR. <br />Engineer will record time required by Engineer and 'Engineer's consultants in evaluating <br />substitutions proposed by CONTRACTOR and in making changes in the Contract <br />Documents occasioned thereby. Whether or not a proposed substitute is used. <br />CON'T'RACTOR shall reimburse OWNER for the charges of Engineer and Engineer's <br />consultants for evaluating each proposed substitute. <br />6.7.6. Substitute materials or equipment may be proposed for acceptance in accordance with <br />these paragraphs (F.1 through F.6). In the event that substitute materials or equipment <br />are used and are less costly than the originally specified material or equipment, than the <br />net difference in cast shall benefit the OWNER and CONTRACTOR in equal proportions. <br />This cost difference shall not be reduced by any failure of the CONTRACTOR to base his <br />bid on the named materials or equipment. <br />Concenaing Subcontractor, Suppliers and Others: <br />6.$ CONTRACTOR shall not employ any Subcontractor, Supplier or other person or <br />organization (including those acceptable to OWNER or ENGINEER as indicated in <br />paragraph 6.10), whether initially or as a substitute, against whom OWNER or ENGINEER <br />may havo reasonable objection. CONTRACTOR shall not be required to employ any <br />Subcontractor, Supplier or other person or organization to furnish or perforin any of the <br />Work against whom CONTRACTOR has reasonable objection.. <br />6.9 The apparent low Bidder, and any other Bidder so requested by the OWNER, shall submit, <br />within seven (7) days after Hie day of the Bid opening, a list of all Subcontractors and other <br />persons and organizations, including those who are to furnish the principal items of <br />material and equipment, with a value in excess of $5.000=- The list shall include the <br />name and address of the Subcontractor, person or organization and a description of the <br />services, materials or equipment to be supplied. <br />6.10 OWNER's or ENGINEER's acceptance (either in writing or by failing to make written <br />objection thereto within ten (10) days of receipt of the list) of any such Subcontractor, <br />Supplier or other person or organization so identified may be revoked on the basis of <br />reasonable objection after due investigation, in which case CONTRACTOR shall submit <br />an acceptable substitute; the Contract Price will be adjusted by the difference in the cost <br />occasioned by such substitution and an appropriate Change Order will be issued or <br />Written Amendment signed. No acceptance by OWNER or ENGINEER or any such <br />Subcontractor, Supplier or other person or organization shall constitute a waiver of env <br />right of UWNER or ENGINEER to reject .defective Work. <br />6.11 CONTRACTOR shall be fully responsible to OWNER and ENGINEER for all acts and <br />omissions of the Subcontractors, Suppliers and other persons and organizations <br />performing or furnishing any of the Work under a direct or indirect contract with <br />CONTRACTOR just as CONTRACTOR is responsible for CONTRACTOR's own acts and <br />emissions. Nothing in the Contract Documents shall create any contractual relationship <br />between OWNER or ENGINEER and any such Subcontractor, Supplier or other person <br />or organization, nor shall it create any obligation on the part of OWNER or ENGINEER to <br />pay or to see to the payment of any moneys due any such Subcontractor, Supplier or other <br />person or organization except as may otherwise be required by Laws and Regulations. <br />GENERAL CONDITIONS <br />.. <br />GC - Iq <br />+s <br />
