i CONTRACTOR, any Subcontractor, any Supplier, or any other person or organization <br />performing any of the Work, or to any surety for any of them. <br />9.14 Whenever in the Contract Documents the terms "as ordered", "as directed", "as required", <br />"as allowed", "as appioved' or terms of like effect or import are used or the adjectives <br />"reasonable", "suitable', "acceptable", "proper" or "satisfactory" or adjectives of like effect <br />or Import arra used to describe a requirement, direction, review orjudgment of ENGINEER <br />as to the Work, it is intended that such requirement, direction, review or judgment will be <br />solely to evaluate the Work for compliance with the Contract Documents (unless there is <br />a specific statement indicating otherwise). The use of any such term or adjective shall not <br />be effective to assign to ENGINEER any duty or authority to supervise or direct the <br />furnishing or performance of the Work or any duty or authority to undertake responsibility <br />contrary to the provisions of paragraph 9.15 or 9.16. <br />9.15 ENGINEER will not be responsible for CONTRACTOR's means, methods, techniques, <br />sequences or procedures of construction, or the safety precautions and programs incident <br />thereto, and ENGINEER will not be responsible for CONTRACTOR's failure to perform or <br />furnish the Work in accordance with the Contract Documents. <br />9.15 ENGINEER will not be responsible for the acts or omissions of CONTRACTOR or of any <br />Subcontractor, any Supplier, or of any other person or organization performing or <br />furnishing any of the Work. <br />10.1 Without invalidating the Agreement and without notice to any surety, OWNER may, at any <br />time or from time to time, given written order of additions, deletions or revisions in the <br />Work as it may find necessary or desirable. These will be authorized by a Written <br />Amendment, a Change Order, or a Worlc Directive Change. Upon receipt of any such <br />document, CONTRACTOR shall promptly proceed with the Work involved which will be <br />performed under the applicable conditions of the Contract Documents (except as <br />otherwise specifically provided), <br />10.2 ff OWNER and CONTRACTOR are unable to agree as to the extent, if any, of an increase <br />or decrease in the Contract Price or an extension or shortening of the Contract Time that <br />should be allowed as a result of a Work Directive Change„ a claim may be made therefor <br />as provided in Article 11 or Article 12, <br />10.3 CONTRACTOR shall not be entitled to an increase in the Contract Price or an extension <br />of the Contract Time with respect to anv Work performcad that iq flat rani+ir—i h.� 4,h- <br />t.:ontract Documents as amended, modified and supplemented as provided in paragraphs <br />3.4 and 3.5, except in the caso of an emergency as provided in paragraph 6.27 and <br />except in the case of uncovering Work as provided in paragraph 13.9. <br />10.4 OWNER and CONTRACTOR shall execute appropriate Change Orders (or Written <br />Amendments) covering: <br />10.4.1 changes in the Work which are ordered by OWNER pursuant to paragraph 10.1, <br />are required because of acceptance of defective Work under paragraph 113.13 or <br />correcting defective Work under paragraph 13.14, or are agreed to by the parties; <br />10.4.2 changes in the Contract Price or Contract Time which are agreed to by the parties; <br />and <br />GENEW.
