f <br />SUPPLEMENTARY CONDITIONS TO GENERAL CONDITIONS <br />A. Introduction <br />These Supplementary Conditions amend or supplement the General Conditions (GC) of <br />the Construction Contract and other provisions of the Contract Documents as indicated <br />r, <br />beiow. All provisions which are not so amended or supplemented remain in full force and <br />effect. <br />D• ?�9�Y <br />No forfeiture clue to delay shall be made because of any delays in the completion <br />of tha vvork due to unforeseeable causes beyond the control and without tate fault <br />or nagligonce of the CONTRACTOR {including but not restricted to Acts of God or <br />of the public enemy, acts of the govemment, acts of the OWNER, or acts of <br />another CONTRACTOR in the performance of a contract with the OWNER, fires, <br />floods, epidemics, quarantine restrictions, strikes, freight embargoes and unusually <br />severe weather or delays of subcontractors due to such causes or delays caused <br />by the failure of the OWNER or the owner of a utility to provide for removal or <br />relocation of existing utility facilities}. Any such delays shall not entitle the <br />CONTRACTOR to any additional compensation. The sole remedy of the <br />CONTRACTOR shall be an extension of time obtained in accordance with this <br />section. <br />2. The CONTRACTOR shall, within five days from the beginning of any such delay, <br />notify the OWNER in writing of the cause of delay, whereupon the OWNER shall <br />ascertain the facts and extent of the delay and extend the time for cornplefing the <br />work if, in his judgment, the findings of fact justify such an extension, and his <br />findings of facts thereon shall be final and conclusive. <br />C. Arrmrs <br />1. As set forth in paragraph 6.15 of the GC, the OWNER has obtain the following <br />permits: <br />a. IRC - Land Clearing, Tree Removal, and Wetland Resource Permits <br />b. SJRWMD - 5tormwater Permit <br />c. ACOS - Wetland Filling Permit <br />_. T ha CONTRAG T OR shad obtain and pay for all other required permits and <br />licenses. The CONTRACTOR shall provide copies of these permits to tete OWNER <br />and Engineer and shall comply with all conditions contained in the permits at no <br />extra cost to the OWNER. <br />3. The CONTRACTOR shall be familiar with all permit requirements during <br />r,onstruction and shall be responsible for complying with these requirements. The <br />cost of this effort shall be included in the pay item which the work is most closely <br />associated with. <br />4. If dewatering is required, the CONTRACTOR shall coordinate with the St, Johns <br />River Water Management District regarding the applicable rules and regulations, <br />SUPPLEMENTAfty CU,OITIONS <br />sc - 1 <br />
