BOOK 98 FACF 538 <br />A Chief judge - Reimbursement of Legal Expenses - Supreme Court <br />The Board reviewed a Memorandum of July 10, 1996: <br />TO: The Board of County Commissioners <br />FROM: William G. Collins 11 - Deputy County Attorney <br />DATE: July 10, 1996 <br />SUBJECT: Reimbursement of Chief Judge's Legal Expenses Before Supreme <br />Court <br />On March 26, 1996 the Board of County Commissioners approved payment of <br />$2,739.50 to the firm of Clem, Polackwich, Vocelle i Taylor as reasonable <br />expenses of the Office of the Chief Judge of the Circuit in legal defgnse of <br />his right to appoint county judges as acting circuit judges. <br />The expenses involved a Writ of Prohibition against the Fourth District Court <br />of Appeal which vacated Judge Vocelle's order appointing a county judge to <br />hear a circuit court felony case and an appeal to the Florida Supreme Court. <br />A $1,021.01 billing for the case was presented to the Board as part of the <br />March 26, 1996 agenda item, however, our office was under the impression that <br />this bill was a subtotal of the $2,739.50 bill paid rather than for a <br />separate case before the Supreme Court. <br />Recommendation: Authorize disbursement of $1,021.01 to the firm of Clem, <br />Polackwich, Vocelle a Taylor pursuant to F.S. 34.171 as a reasonable expense <br />of the Chief Judge of the Nineteenth Judicial Circuit in defending before the <br />Supreme Court his power of appointment of county judges to hear felony <br />circuit court cases. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously approved <br />disbursement of $1,021.01 to the firm of Clem, <br />Polackwich, Vocelle & Taylor, as recommended by <br />staff. <br />E. Vero Beach High School Marching Band - Loan 2 Golf Carts <br />The Board reviewed a Memorandum of July 5, 1996: <br />TO: Board of County <br />FROM: Bob xomar4rijkz/,1196lf flub Director <br />DATE: July 5, <br />RE: Temporary Loan of Two Golf Carts to the <br />Vero Beach High School Marching Band - CONSENT AGENDA <br />A request has been made on behalf of the Vero Beach High School Marching Band <br />by the Band Boosters to borrow two of the County's golf carts for use in <br />their annual band camp training in Tallahassee August 3-9, 1996. (Please see <br />the attached memo from Jeff Smith, Treasurer of the Band Boosters.) <br />Since the first week in August is typically a very slow one, we would have <br />two golf carts which could be loaned out and feel that the gesture would be <br />in the public interest for the golf course by supporting a well-known group <br />which attracts golfing tourists to our community. We also feel that this <br />good -will gesture on the part of the County golf course may encourage members <br />of the band itself to take up golf. <br />We, therefore, recommend that you approve the one-week loan. <br />JULY 169 1996 8 <br />
