In an attempt to expedite a resolution to the Sebastian ifighlands issue, the FWS believes the <br />preparation of a smaller scale, stand-alone HCP for the Sebastian Frtgldands area is the only way <br />in which scrub jay conservation and residential interests will be mutually satisfied in a timely <br />manner. Though we have not discussed this approach in detail, we believe it will be much <br />easier to implement than the phasing in of the Sebastian Fruthlands portion of a countywide <br />HCP. It is our understanding that the City of Sebastian now has current biological data for <br />scrub jays within Sebastian Eaghlands. This information, coupled with the enclosed HCP <br />guidelines, should provide a good foundation for an HCP for Sebastian Highlands. Discussions have been <br />held with the Environmental Learning Center and the School Board <br />regarding some involvement in management of the project. Staff is <br />recommending that the Board agree to exercise its purchase option <br />for the reduced number of lots. The original contract expired on <br />July 1, 1996 but staff has written confirmation from AGC of an <br />amendment to extend the contract and to eliminate the 6 lots <br />discussed. In response to Commissioner Bird's question, Mr. <br />DeBlois advised that the purchase price for the 56 lots was based <br />on the appraised value of the lots, while AGC has agreed to reduce <br />the contract price by the actual appraised value of the 6 lots <br />which would be $41,200. <br />Commissioner Bird then inquired whether anyone had been denied <br />a building permit to build on any of these lots, and Mr. DeBlois <br />was not aware of any. <br />Commissioner Bird questioned whether the City of Sebastian has <br />any requirement that platted lots must be maintained as these lots <br />will be left in their natural state. <br />Commissioner Macht asked about the lack of infrastructure <br />which affected the value of the lots and wanted to know whether <br />acquiring a deed to all of the property had been discussed. <br />Mr. DeBlois advised that the City of Sebastian would abandon <br />those streets which will not be needed. <br />Tom Frame, Sebastian City Manager, advised that the City has <br />no requirement that an undeveloped lot be mowed.
