Chandler <br />County Administrator <br />D ISO HEAD CONCURRENCE: <br />01 <br />obert INT'Keldtincli AI <br />Community Develop ent irector <br />FROM: Sasan Rohani, AICP 1 '�-- <br />Chief, Long -Range Planning <br />DATE: July 9, 1996 <br />RE: CONSIDERATION OF PROPOSED WORKSHOP DATES FOR REVIEW OF <br />THE PROPOSED COMPREHENSIVE -PLAN EVALUATION AND APPRAISAL <br />REPORT <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of July 16, 1996. <br />BACKGROUNDm <br />All local governments in Florida are required to develop a <br />Comprehensive Plan and to periodically review and assess that plan <br />through preparation of an Evaluation and Appraisal Report (EAR). <br />According to state rules, Indian River County must submit its <br />adopted EAR to the state by January 1, 1997. The Planning and <br />Zoning Commission, (P&Z) as the county's designated local planning <br />agency, is charged with preparation of the evaluation and appraisal <br />report. <br />Although the adopted Evaluation and Appraisal Report is not due to <br />the state until January 1, 1997, state law requires that the local <br />planning agency approve and submit the EAR to the state at least 90 <br />days prior to the county's January 1, 1997 EAR submittal date. <br />Accordingly, the local planning agency (the Planning and Zoning <br />Commission) must consider, approve, and submit the county's EAR to <br />the State Department of Community Affairs by October 1, 1996. <br />DESCRIPTION AND CONDITIONS: <br />Since November 1995, planning staff has worked with the Planning <br />and Zoning Commission and other local committees, as designated by <br />the evaluation and appraisal report public participation plan, to <br />prepare evaluation and appraisal reports for the 17 elements and <br />sub -elements of the county comprehensive plan. As of this time, <br />these drafts have not been presented to the Board of County <br />Commissioners for their consideration. <br />While state law requires that the Board of County Commissioners <br />adopt the final EAR prior to the January 1, 1997 submittal date, <br />state law does not require that the Board adopt, approve, or <br />authorize the EAR required to be submitted to the state by the <br />local planning agency prior to October 1, 1996. Even though state <br />regulations do not mandate board action, staff feels that the Board <br />should consider the draft EAR in at least a workshop format prior <br />to the Planning and Zoning Commission's September 12, 1996 EAR <br />public hearing. <br />For that reason, staff proposes that the Board schedule a workshop <br />meeting in late August to consider the draft EAR. In scheduling a <br />workshop, the Board has two principal alternatives. If the Board <br />wants to discuss the draft EAR in detail, the Board could schedule <br />a special workshop meeting either during the evening or during the <br />day. If, on the other hand, the Board wants only a general <br />discussion at this time, a brief woAkshop could be held during a <br />regular BCC meeting. One possiLle meeting date for the EAR <br />workshop would be August 27, 1996. <br />After submittal of the local planning agency approved EAR to the <br />state, there will be about three months until.'the Board has to <br />adopt the EAR.
