VM11D%99080D27.SOS <br />27 April 1999 <br />Page 4 <br />Should such circumstances occur, the non-performing party shall, within a reasonable <br />time of being prevented from performing, give written notice to the other party, <br />describing the circumstances preventing continued performance and the efforts being <br />made to resume performance of this Scepe of Services. <br />3.5 The services performed by L&A shall be conducted in a manner consistent with that <br />level of care and shill ordinarily exercised by members of the environmental <br />consulting profession in the same locale and acting under similar circumstances and <br />conditions. Except as set forth herein, L&A makes no other representation, <br />guarantee, or warranty, expressed or implied, in fact or by law, whether of <br />merchantability, fitness for any particular purpose or otherwise, concerning any of the <br />services which may be furnished by L&A to the Client. <br />9 <br />3.0 The services will be performed on behalf of and solely for the exclusive use of Client <br />and its successor or assigns. <br />3.7 The parties deem the work to be done as the performance of services of a landscape <br />architect or engineer within the meaning and intent of the Florida Statute 713.03.. <br />3.8 If governmental regulations change during the course of this project such that <br />additional site reviews are requested by the governmental agency, any such required <br />modifications or additional site reviews will be submitted as an additional cost. If <br />changes are requested by the governmental agencies or the Client which is not a result <br />of consultant error or omission, these services will be submitted as an additional cost. <br />It is assumed that no physical changes will occur to the property during the time frame <br />of this study. <br />3.9 No subsurface, soil, water, or hazardous materials investigations are included within <br />the scope of this project. <br />
