Chairman Adams opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, she closed <br />the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously adopted <br />Ordinance 96-16, rezoning from RS -6 to RM -8 property <br />located at the southeast corner of 41st Street and <br />Indian River Boulevard. <br />ORDINANCE NO. 96-16 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM RS -6 TO <br />RM -8, FOR THE PROPERTY LOCATED AT THE SOUTHEAST CORNER OF 41ST <br />STREET AND INDIAN RIVER BOULEVARD, AND DESCRIBED HEREIN, AND <br />PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation' regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that <br />this rezoning is in conformance with the Comprehensive Plan of <br />Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />A PARCEL OF LAND LYING IN SECTION 25, TOWNSHIP 32 SOUTH, RANGE <br />39 EAST, INDIAN RIVER COUNTY, FLORIDA BEING THAT PORTION OF <br />THE NORTHEAST QUARTER OF THE SOUTHWEST QUARTER, LYING EASTERLY <br />OF THE EASTERLY RIGHT-OF-WAY LINE OF INDIAN RIVER BOULEVARD. <br />LESS HOWEVER THE FOLLOWING DESCRIBED PARCEL OF LAND: <br />BEGIN AT THE NORTHWEST CORNER OF THE NORTHEAST QUARTER OF THE <br />SOUTHWEST QUARTER; THENCE SOUTH 89051'33" EAST ALONG THE <br />QUARTER SECTION LINE, A DISTANCE OF 145 FEET; THENCE SOUTH <br />00008'27" WEST, A DISTANCE OF 50 FEET; THENCE NORTH 89051'33" <br />WEST, A DISTANCE OF 125 FEET; THENCE SOUTH'45006'27" WEST, A <br />DISTANCE OF 27.80 FEET TO THE WEST LINE OF SAID NORTHEAST <br />QUARTER OF THE SOUTHWEST QUARTER; THENCE NORTH 00008'36" WEST, <br />A DISTANCE OF 69.65 FEET TO THE POINT OF BEGINNING. <br />AND ALSO LESS THAT PORTION LYING EAST OF THE FOLLOWING <br />DESCRIBED LINE: <br />66 <br />JULY 239 1996 Boos F;�,r 4 <br />
