If the Contractor shall assign this Contract or any money accruing thereon or approval <br />thereon, or abandon the work or is adjudged a bankrupt, or if he makes a general <br />assignment for the benefit oi`his creditors, or if trustee or receiver is appointed for <br />the contractor or for any of his property, or if he shall refuse or neglect to comply with <br />the instructions of the Owner or Engineer relative thereto, or shall in any manner fail <br />to comply with the Specifications and stipulations herein contained, The Owner shall <br />have the right to annul and cancel this Contract and proceed to advertise and re -let a <br />contract for the unfinished work, and such annulment shall not entitle the Contractor <br />to any claim for damages on account thereof, nor shall it affect the right of the Owner <br />to recover damages on account of such failure. <br />24. PROTECTION OF PUBLIC: <br />A. The Contractor shall erect and maintain barricades and sufficient safeguards around <br />all excavation, embankments or obstructions; he shall place sufficient amber lights at <br />or near the work, keep the same bunting from sunset to sunrise, employ watchmen and <br />strictly obey all laws and ordinances controlling or limiting those engaged on similar <br />work. All maintenance of traffic work shall comply with Section 102 and Special <br />Provision Item 102-1 of the Florida Department of Transportation. Standard <br />Specifications for Road and Bridge Construction. <br />B. Where there are telephone, telegraph, -light, or power poles, water main, conduits, <br />pipe, or drains; or other construction either public or private; in or on the streets or <br />alleys; the work shall be so conducted that no interruption or delay will be caused in <br />the operation or use of the same. Proper written notice shall be given and all the <br />facilities afforded the owners of such construction encountered or likely to be <br />encountered, as will enable them to preserve the same from injury. <br />C. The Contractor will not be permitted to interfere with public travel and convenience <br />by grading or tearing up streets indiscriminately, but the work of conducting the <br />various items ofthis Contract shall proceed in an orderly, systematic and progressive <br />manner. <br />25. PUBLIC ENTI"T"Y CRIMES: The Contractor shall complete, and execute in the presence of <br />a notary, or other officer authorized to administer oaths, the sworn statentent under Section <br />28T133(3;(ajF.S., Form PEC -1 of this contract. <br />26. DISCLOSURE OF RELATIONSHIPS: The Contractor shall complete, and execute in the <br />presence of a notary, or other officer autharired to administer oaths, the sworn statement <br />under Section 105,08, Indian River County Code, Form DOIR_ l of this contract. <br />GC --10 <br />
