of the Contract Docurnents or any breach thereof shall include by consolidation, joinder, or joint filing <br />any additional person or entity riot a party to this Agreement to the extent necessary for the final <br />resolution of the matter in controversy. <br />16.8 At least one of file members of the arbitration panel must be an attorney licensed to practice law in the <br />State of Florida. <br />16.9 The surety shall be mound by the arbitration award to the same extent as the CONTRACTOR is <br />bound. <br />16.10 The arbitration panel shall submit a written opinion with findirngs of fact and conclusions of law stating <br />the basis for the decision made, and including an award of arbitration that may be confirmed by a <br />court of competent jurisdiction. <br />16.11 unless OWNER agrees to the contrary, the location of any and all arbitration proceedings shall be in <br />the county in which the Project is located. <br />Giving Notice: <br />17.1 Whenever any provision of cite Contract Documents requires the giving of written notice, it will bo <br />deemed to have been validly given if delivered in person to the individual or to a member of tine firm <br />or to an officer of the corporation for whom it is intended, or if delivered at or sent by registered or <br />certified mail, postage prepaid, to the last business address known to die giver of the notice. <br />Computation of Time: <br />17.2 When any period of time is referred to in die Contract Documents by days, it will be computed to <br />exclude the first and include the last day of such period, If the last day of any such period falls on a <br />Saturday or Sunday or vin a day made a legal holiday by the law of the applicable junsdiction, such <br />day will be omitted front the computation. <br />17.3 A calendar day of twenty-four (24) hours measured from midnight to the next midnifiit shall constitute <br />a day. <br />General: <br />W' 17.4 Should OWNER or CONTRACTOR suffer injury or damage to person or property because of any <br />error, omission or act of the other parity or of any of the other party's employees or agents or others <br />for whose acts the other ,party is legally liable, claim will be made in writing to the ot1wr party within <br />a reasonable time ofthe first observance of such injury or damage. The provisions ofttnis paragraptn <br />17.4 shall not be construed as a substitute for or a waiver of the provisions of any applicable statute <br />of limitations or repose. <br />17.5 The duties and obligations 'imposed by these Gencral Conditions and the rights and remedies available <br />k <br />k <br />hereunder to the parties hereto, arid, in particular but without limitation, the warranties, guarantees and <br />obligations imposed upon CONTRACTOR by paragraphs 6.36,6.37,13. 1, 13 -12,13.14,14.3 and 15.2 <br />and all of the rights and remedies available to OWNER and ENGINEER thereunder, are in addition <br />to, and are not to be const imd in any way as a limitation of, arty rights and remedies available to any <br />or all ofthem which are otherwise imposed or available by Laws or Regulations, by special warranty <br />or guarantee or by other provisions of the Contract Documents, and the provisions of this paragraph <br />GENERAL CONDITIONS <br />GC - 37 <br />
