• <br />0 <br />16.5. Owner reserves the right to reject the Bid of any Bidder who does not pass <br />any such evaluation to Owner's satisfaction. <br />16.6. If the contract is to be awarded, it will be awarded to the lowest responsive, <br />�A responsible Bidder on the basis of the Total Base Bid. <br />16.7. If the contract is to be awarded, Owner will give the Successful Bidder a <br />Notice of Award within sixty days after the day of the Bid opening. <br />17. Performance anc OtLerDQnds <br />Paragraph 5.1 of the General Conditions and the Supplementary Conditions set <br />forth Owner's requirements as to performance and payment Bonds. When the <br />esuccessful Bidder delivers the executed Agreement to Owner it shall be <br />accompanied by the required Contract Security, unless the Bonds have been <br />waived due to the total contract being less than $50,000. <br />18. Interpretation of the Approximate Quantities <br />The Bidders attention is called to the fact that any estimate of quantities of work to <br />be done and materials to be furnished under the Specifications as shown on the Bid <br />Schedule, or elsewhere, is approximate only and not guaranteed, The Owner does <br />not assume any responsibility that the final quantities shall remain in strict <br />accordance with the estimated quantities, nor shall the Contractor plead <br />misunderstanding or deception because of such estimate of quantities or of the <br />character, location of the work, or other conditions pertaining thereto. <br />19. Execution -of Contract <br />I <br />The Bidder to whom the Contract is awarded shall, within ten (10) days of the <br />Notice of Award, execute and deliver five (5) copies of the following to the <br />Engineer: <br />{ a. Agreement <br />b. Performance Bond(If required) <br />c. Payment Bond(If required) <br />d. Certificate of Insurance <br />20. FAILURE TO EXEQ,UIELCONTRACT <br />Should bidder to whore the contract has been awarded refusa or fail to complete <br />the requirements of Article 19 above within ten (10) days after Notice of Award, the <br />additional time in calendar days required to correctly complete the documents will <br />be deducted, in equal amount, from the Contract time, or the County may elect to <br />revoke Bid Bond of any Bidder failing to execute the awarded Contract shall be held <br />by the County for consequential damages incurred, and the Contract awarded as <br />the Commission desires. <br />rINSTRUCTIONS TO BIDDERS <br />IB -7 <br />
