db <br />40 <br />G <br />are subject to modification in accordance with separate <br />procedures governed by FEMA regulation. Modifications to the <br />terms and conditions of this Agreement shall be proposed in <br />writing by either party and become effective only upon execution <br />by both parties. Modifications to any PW or the time for <br />performance of eligible work shall be requested through the <br />Grantee, approved solely at the discretion of FEMA and shall be <br />reflected in a supplemental PW or time extension approval. <br />Modifications to a PW shall not be reflected in a modification to <br />thir3 Agreement. If otherwise allowed under this Agreement, any <br />extennion shall be in writing and shall be subject to the same <br />terms and conditions set forth in the initial Agreement. There <br />nhall be only one extension of th- Agreement unless; the failure <br />to meet the criteria for complptin_n is due to events beyond the <br />control. of they Subgrantee. <br />16. TIME FOR PERFORMANCS: All activities funded under this <br />Agreement shall be timely performed and completed. In accordance <br />with 44 CFR 206.204, and subject to any approved extension by the <br />Governor's Authorized Representative (GAR) or the Federal <br />Regional Director, the term for performance of debris clearance <br />or emergency work is six (6) months from the date of the <br />declaration of a major disaster or emergency. Permanent <br />(restoration) work must be completed within eighteen (18) months <br />of the date of the Presidential Declaration of a major disaster. <br />Time extenuiono may be granted on an iiidividual babis, i.ii <br />accordance with 44 CFR 206.204.
