t! <br />r <br />r <br />t <br />® i 16,9 The surety shall be bound by the arbitration award to the same extent as the CONTRACTOR is <br />bound. <br />I <br />16.10 The arbitration panel shall submit a written opinion with findings of fact and conclusions of law <br />stating the basis for the decision made, and including an award of arbitration that may be confirmed <br />t by a court of competent jurisdiction. <br />16.11 Unless OWNER agrees to the contrary, the location of any and all arbitration proceedings shall be <br />in the county in which the Project is located. <br />I <br />Giving Notice, <br />i 17.1 Whenever any provision of the Contract Documents requires the giving of written notice, it will be <br />I decincd to have been validly given if delivered in person to the individual or to a member of the firm <br />or to an officer of the corporation for whom it is intended, or if delivered at or sent by registered or <br />f certified mail, postage prepaid, to the last business address known to the giver of the notice. <br />1 <br />Computation of Time: <br />4 <br />i 17.2 When any period of time is referred to in the Contract Documents by days, it will be computed to <br />exclude the first and include the last day of such period, If the last day of any such period falls on <br />a Saturday or Sunday or on a day made a legal holiday by the law of the applicable jurisdiction, such <br />I day will be omitted from the computation. <br />t <br />17.3 A calendar day of twenty-four (24) hours measured from midnight to the next midnight shall <br />I constitute a day. <br />i <br />General: <br />t 17.4 Should OWNER orCONTRACTOR suf c injury or damage to person or property because of any <br />error, omission or act of the other party or of any of the other party's employees or agents or others <br />i for whose acts the otherparty is legally liable, claim will be made in writing to the other party within <br />y, a reasonable time of the first observance of such injury or damage.
