4D <br />• <br />• <br />"suitable", "acceptable'", "'proper'" or ""satisfactory" or adjectives of like effect or import are used to <br />describe a requirement, direction, review or judgment of ENGINEER as to the Work, it is intended <br />that such requirement, direction, review or judgment will be solely to evaluate the Work for <br />compliance with the Contract Documents (unless there is a specific statement indicating otherwise). <br />m <br />The use of any such teror adjective shall not be effective to assigns to ENGINEER any duty or <br />authority to supervise or direct the furnishing or perfonnance of the Work or any duty or authority <br />to undertake responsibility contrary to the provisions of paragraph 9.15 or 9.16. <br />9.15 ENGINEER will not be responsible for CONI'RACTOR's means, methods, techniques, sequences <br />or procedures of construction, or the safety precautions and programs incident therein, and <br />ENGINEER will not be responsible for CONTRACTOR's failure to perform or furnish the Work <br />in accordance with the Contract Documents. <br />9.16 ENGINEER will not be responsible for the acts or omissions of CONTRACTOR or of any <br />Subcontractor, any Supplier, or of any other person or organization performing or furnishing any of <br />the Work, <br />ARTICLE ] - CHAMUS IiiTom_ OR <br />10.1 Without invalidating the Agreement and without notice to any surely, OWNER may, at any time or <br />from time to time, given written order of additions, deletions or revisions in the Work as it may find <br />necessary or desirable. These will be authorized by a Written Amendment, a Change Order, or a <br />Work. Directive Change. Upon receipt of any such document, CONTRACTOR shall promptly <br />proceed with the Work involved which will be performed under the applicable conditions of the <br />Contract Documents (except as otherwise specifically provided). <br />10.2 If OWNER and CONTRACTOR arc unable to agree as to the extent, if any, of an increase or <br />decrease in the Contract Price or an extension or shortening of the Contract Time that should be <br />allowed as a result of a Work Directive Change, a claim may be made therefor as provided in Article <br />1 1 or Article 12. <br />10.3 CONTRACTOR shall not be entitled to an increase in the Contract Price or an extension of the <br />Contract Time with respect to any Work performed that is not required by the Contract Documents <br />as amended, modified and supplemented as provided in paragraphs 3.4 and 3.5, except in the case <br />of an emergency as provided in paragraph 6.21 and except in the case of uncovering Work as <br />provided in paragraph 13.9. <br />10.4 OWNER and CONTRACTOR shall execute appropriate Change Orders (or Written Amendments) <br />covering: <br />30.4.1 changes in the Work which are ordered by OWNER pursuant to paragraph 10, 1, are <br />required because of acceptance of r1cfecrive Work tinder paragraph 13.13 or <br />correcting rkfecrrve Work under paragraph 13.14, or are atn°ed to by the 1x+1'!tcd: <br />10.4.2 changes in the Contract Price or Contract Time which are agreed to by the parties, <br />and <br />10.4.3 changes in the Contract Price or Contract Time which embody the substance orany <br />written decision rendered by ENGINEER pursuant to paragraph 9.11; <br />piuvided that, in lieu of executing any such Change Order, an appeal may he taken <br />from any such deciston in accordance with the provision,. of lhv Unntr:ic•t <br />tit?NYRAL CONDI HONS <br />etc - 22 <br />
