41111110 <br />40 <br />J <br />. , <br />AGREEMENT <br />between the <br />Winter Beach Cemetary Association, Inc. <br />and the <br />Indian River County Board of County Commissioners <br />For: Land Exchange for Additional Burial Sites <br />ORIGINAL, <br />00-40 <br />This agreement, made and entered into this 22nd day of February , 2000, <br />by and between Indian River County, a political subdivision of the State of Florida, <br />1840 25'h Street, Vero Beach, FL 32960 ("COUNTY") , and Winter Beach Cemetary <br />Association, Inc., a not-for-profit corporation organized under the laws of the State of <br />Florida, Post Office Box 193, Winter Beach, FL 32971 (ASSOCIATION), <br />WITNESSSETH THAT: <br />WHEREAS, ASSOCIATION exists for the purpose of providing low-cost burials <br />in the Wabasso-Indian River County area; and <br />WHEREAS, COUNTY is responsible for the burial of indigent people and will <br />have the need over the next 50 years for approximately 750 indigent burial sites; and <br />WHEREAS, ASSOCIATION is willing to provide these sites to COUNTY at no <br />charge provided COUNTY acquires the land described in Exhibit "A" (hereinafter <br />Property #1); and <br />WHEREAS, ASSOCIATION owns the land described in Exhibit "B" (hereinafter <br />Property #2), and as additional inducement to COUNTY to purchase Property #1, <br />ASSOCIATION will deed its property to COUNTY to be used by COUNTY for parks and <br />recreation or other governmental functions; <br />NOW, THEREFORE, for and in consideration of the mutual covenants and other <br />good and valuable consideration, the receipt of which is hereby acknowledged, <br />COUNTY and ASSOCIATION agree as follows: <br />1. COUNTY shall purchase Property #1 and deed it to ASSOCIATION. <br />2. ASSOCIATION shall deed Property #2 to COUNTY. <br />
