E-] <br />40 <br />40 <br />40 <br />ORIGINAL <br />---57 <br />AMENDMENT NO. 1 TO CONTRACT FOR <br />INDIAN RIVER COUNTY <br />UNDERGROUND FACILITIES LOCATING <br />AND MARKING SERVICES <br />THIS AMENDMENT NO. 1 TO CONTRACT FOR UNDERGROUND FACILITIES <br />LOCATING AND MARKING SERVICES is made and entered into this 7th day of MARCH, <br />2000, by and between NOCUTS, Inc. (Hereinafter referred to as Contractor) and INDIAN RIVER <br />COUNTY (hereinafter referred to as Customer). <br />WHEREAS, Contractor and Customer (hereinafter collectively referred to as the Parties) <br />previously entered into a Contract for Underground Facilities Locating and Marking Services on <br />January 7, 1997, (hereinafter referred to as the Agreement); and <br />WHEREAS, the Parties desire to amend the Agreement; <br />NOW THEREFORE, in consideration of the mutual covenants and agreements hereinafter <br />set forth, the Parties hereto agree to amend the Agreement as follows; <br />Either party upon thirty (30) days written notice to the other party may terminate this <br />contract. Unless so terminated, this contract shall continue in effect through: September 30, <br />2000. <br />This contract may be renewed, by mutual agreement, for additional ONE (1) YEAR periods up to <br />a cumulative total of THREE (3) YEARS at the same prices, terms and conditions. Any change in <br />price, terms or conditions shall be accomplished by written amendment to this contract with final <br />approval requiring Indian River County Board of county Commissioners (IRCBCC) action. <br />Except as herein amended, all other terms and conditions of the Agreement shall remain <br />unchanged and in full force and effect. <br />IN WITNESS WHEREOF, the Parties hereto have caused duplicate originals of this <br />Amendment No. 1 to the Contract for Underground Facilities Locating and Marking Services to be <br />executed by their duly authorized representatives as of the day and year first above written. <br />A E.1- c <br />IN'DIANRIW311COUNTY 46C4.- tnc. <br />Fran B.
