Each of these 14 criteria has been addressed by the applicant, <br />subject to the conditions outlined in staff's recommendation, <br />below. <br />16. Dedications and Improvements: The LDRs do not require any <br />dedications or improvements connected with the proposed <br />development of this site. <br />Based on the analysis performed, staff recommends that the Board of <br />County Commissioners grant special exception use approval for the <br />requested -tower with the following conditions: <br />1. That prior to site plan release, the applicant shall obtain a <br />county "airport construction permit". <br />2. That prior to site plan release, the applicant shall execute <br />an agreement acceptable to the County Attorney's Office that <br />acknowledges the tower shall be available for other parties <br />and interests. <br />3. That prior to site plan release, the applicant shall document <br />to the County Attorney's Office satisfaction that .no <br />residences will be allowed within the tower's fall radius. <br />Planning Director Stan Boling reviewed the project and advised <br />that AT&T also has other applications in process at this time. The <br />Planning & Zoning Commission voted 4-2 to grant this special <br />exception. In response to a question by Chairman Adams, Director <br />Boling advised that AT&T leases the tower area; however, the radius <br />of the tower is much larger than the leased area so an agreement <br />between all the property owners is required that no residences will <br />be allowed within the fall area of the tower. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. <br />Cliff Hertz, attorney for AT&T, stated that AT&T has 4 towers <br />in the east portion of the county and is looking for permission for <br />2 more in the western area. Mr. Hertz explained that when the <br />demand for use of the equipment grows, there is a greater need for <br />more sites. Generally they look for tall structures which could be <br />used as a tower base and secondly, they approach the owners of <br />existing communications towers and evaluate whether the current <br />user would interfere with their use. In this particular case, none <br />of these facilities were available. AT&T is not in the tower <br />building business but this is a last resort in order to adequately <br />fill the demand for service. <br />Curt Nicconin, project engineer for AT&T, presented an <br />overhead showing the present AT&T coverage in the County and the 2 <br />additional proposed sites that would fill in the western part of <br />the County and give seamless coverage along I-95 and SR -60. <br />AUGUST 13, 1996 43 800.,,' _ 7856 <br />
