INDIAN RIVER COUNTY <br />PARKS RECREATION & CONSERVATION LICENSE AGREEMENT <br />License Preparation <br />December 15, 2023 <br />License Duration: <br />March 15-16, 2024 <br />Date: <br />United Way of Indian River <br />Organization: <br />County Inc. <br />Contact Name: <br />Jessica Schmitt <br />Address: <br />1836 14`h Avenue <br />Phone: <br />772-567-8900 <br />City/State/zip Code: <br />Vero Beach, FL 32960 <br />E -Mail: <br />Jessica.schmitt@unitedwayirc.org <br />Name of Event: <br />St. Paddles Day Pickleball <br />Expected <br />200 <br />Tournament <br />Attendance: <br />Event Time: <br />3/15 5-9p.m. & 3/16 8a.m: 8p.m. <br />Load -Out <br />3/16/24 9:00 p.m. <br />Load -In Date/Timc: <br />4:00 m. <br />p• <br />Datefrime: <br />WITNESSETH: <br />WHEREAS, Indian River County (the "County") is the owner of certain property known as the <br />Dick Bird (South County) Regional Park, and subsequent twelve (12) court pickleball complex within the <br />Park, located in Indian River County, Florida, (the "Courts"); and <br />WHEREAS, the County has the authority to issue and/or:execute, and United Way of Indian River <br />County, Inc., (the "Applicant") desires the issuance and/or execution of, a permit/agreement for the <br />utilization of the Courts, which Applicant has inspected and hereby acknowledges to be sufficient for its <br />intended purpose and/or use contemplated hereunder; and <br />WHEREAS, Applicant warrants to the County that it is qualified and authorized to do business in <br />the State of Florida and Indian River County, Florida and has or will obtain and maintain the proper <br />certification, licensure, insurance, permits and all other requirements pursuant to federal, state and local <br />laws, statutes, ordinances, rules and regulations necessary to conduct any and all activities contemplated <br />herein, and to satisfactorily perform its obligations as herein required; and <br />WHEREAS, the Applicant acknowledges that the use of the Courts is subject to and expressly <br />conditioned by section 205.04 (Permits) of the Indian River County Code of Ordinances, if applicable at the . <br />time of the License Duration, which are hereby incorporated by reference when applicable; <br />NOW, THEREFORE, for and in consideration of the use of the Courts and other valuable <br />consideration, the legal sufficiency of which is hereby acknowledged by both parties, and of the mutual <br />covenants herein contained, the parties, as indicated by their authorized representatives' signatures below, <br />hereby agree to the terms and conditions set forth herein: <br />A. PARK, PREMISES & EVENT SCHEDULE: <br />This Indian River County Parks, Recreation & Conservation License Agreement ("License <br />Agreement") applies to all events for the use of the Courts.
