<br />requirement.
<br />Section 22. FEDERAL AND FLORIDA SINGLE AUDIT ACT (FSAA) REQUIREMENTS.
<br />Pursuant to the FSAA (or Federal) Vendor / Recipient Determination Checklist, the Recipient has been
<br />determined to be a recipient of state financial assistance and/or a subrecipient of a federal award. Therefore,
<br />pursuant to Section 215.97, F.S. and/or OMB Uniform Guidance (2 CFR 200), the Recipient may be subject to the
<br />audit requirements of the Florida and/or Federal Single Audit Acts. If applicable, the Recipient shall comply with
<br />the audit requirements outlined in Attachment B, attached hereto and made a part of the Agreement, as applicable.
<br />Section 23. FEDERAL COMPLIANCE.
<br />As applicable, Recipient shall comply with all federal laws, rules, and regulations, including but not limited to:
<br />A. Clean Air Act and Water Pollution Control Act.
<br />All applicable standards, orders, or requirements issued under the Clean Air Act (42 U.S.C. 7401-767lq),
<br />and the Water Pollution Control Act (33 U.S.C. 1251-1387, as amended).
<br />B. Lacey Act, 16 U.S.0 3371-3378.
<br />This Act prohibits trade in wildlife, fish and plants have been illegally taken, possessed, transported or sold.
<br />C. Magnuson -Stevens Fishery Conservation and Management Act, 16 U.S.C. 1801-1884.
<br />This Act governs marine fisheries in Federal waters.
<br />D. Migratory Bird Treaty Act, 16 U.S.C. 703-712.
<br />The Act prohibits anyone, unless permitted, to pursue, hunt, take, capture, kill, attempt to take, capture or
<br />kill, possess, offer for sale, sell, offer to purchase, deliver for shipment, ship, cause to be shipped, deliver
<br />for transportation, transport, cause to be transported, carry or cause to be carried by any means whatsoever,
<br />receive for shipment, transport of carriage, or export, at any time, or in any manner, any migratory bird, or
<br />any part, nest, or egg of such bird.
<br />E. Endangered Species Act, 16 U.S.C. 1531, et seq.
<br />The Act provides a program for the conservation of threatened and endangered plants and animals and the
<br />habitat in which they are found. The Act also prohibits any action that cause a "taking" of any listed species
<br />of endangered fish or wildlife. Also, generally prohibited are the import, export, interstate, and foreign
<br />commerce of listed species.
<br />Section 24. FEDERAL FUNDS.
<br />This Agreement relies on federal funds, therefore, the following terms and conditions apply:
<br />A. Prior Approval to Expend Federal Funds to Federal Agency or Employee.
<br />It is understood and agreed that the Recipient is not authorized to expend any federal funds under this
<br />Agreement to a federal agency or employee without the prior written approval of the awarding federal
<br />agency.
