A TRUE COPY <br />CERTIFICATION ON LAST PAGE <br />RYAN L. BUTLER, CLERK <br />FWC Agreement No. 23214 <br />C. General Liability Insurance. <br />By execution of this Agreement, unless Recipient is a state agency or subdivision as defined by Subsection <br />768.28(2), F.S. or unless otherwise provided for in Attachment A, the Recipient shall provide reasonable <br />and adequate commercial general liability insurance coverage and hold such liability insurance at all times <br />during the Agreement. A self-insurance program established and operating under the laws of the State of <br />Florida may provide such coverage. <br />D. Insurance Required for Performance. <br />During the Agreement term, the Recipient shall maintain any other types and forms of insurance required <br />for the performance of this Agreement as required in Attachment A. <br />E. Written Verification of Insurance. <br />Upon execution of this Agreement, the Recipient shall provide the Commission written verification of the <br />existence and amount for each type of applicable insurance coverage. Within thirty (30) days of the <br />effective date of the Agreement, Recipient shall furnish proof of applicable insurance coverage to the <br />Commission's Grant Manager by standard Association for Cooperative Operations Research and <br />Development (ACORD) form certificates of insurance. In the event that any applicable coverage is <br />cancelled by the insurer for any reason, Recipient shall immediately notify the Commission's Grant <br />Manager in writing of such cancellation and shall obtain adequate replacement coverage conforming to the <br />requirements herein and provide proof of such replacement coverage within fifteen (15) business days after <br />the cancellation of coverage. <br />F. Commission Not Responsible for Insurance Deductible. <br />The Commission shall be exempt from, and in no way liable for, any sums of money representing a <br />deductible in any insurance policy. The payment of such deductible shall be the sole responsibility of <br />Recipient providing such insurance. <br />Section 17. SPONSORSHIP. <br />As required by Section 286.25, F.S., if the Recipient is a nongovernmental organization which sponsors a <br />program financed wholly or in part by state funds, including any funds obtained through this Agreement, it shall, <br />in publicizing, advertising, or describing the sponsorship of the program, state: "Sponsored by (Recipient's name) <br />and the State of Florida, Fish and Wildlife Conservation Commission." If the sponsorship reference is in written <br />material, the words "State of Florida, Fish and Wildlife Conservation Commission" shall appear in the same size <br />letters or type as the name of the Recipient's organization. Additional sponsorship requirements may be specified <br />in Attachment A. <br />Section 18. PUBLIC RECORDS. <br />A. All records in conjunction with this Agreement shall be public records and shall be treated in the same <br />manner as other public records that are under Chapter 119, F.S. <br />B. This Agreement may be unilaterally canceled by the Commission for refusal by the Recipient to allow <br />public access to all documents, papers, letters, or other material subject to the provisions of Chapter 119, <br />F.S., and made or received by the Recipient in conjunction with this Agreement, unless exemption for <br />such records is allowable under Florida law. <br />Recipient/Subrecipient Agreement Last Revised: 3.20.2023 Page 15 of 29 <br />
