FWC Agreement No. Enter CFDA Number(s) <br />J. Procurement of Recovered Materials <br />i. In the performance of this Agreement, the Recipient shall make maximum <br />use of products containing recovered materials that are EPA -designated <br />items unless the product cannot be acquired— <br />a. Competitively within a timeframe providing for compliance with the <br />Agreement performance schedule; <br />b. Meeting Agreement performance requirements; or <br />c. At a reasonable price. <br />ii. Information about this requirement, along with the list of EPA- designated <br />items, is available at EPA's Comprehensive Procurement Guidelines. <br />iii. The Recipient also agrees to comply with all other applicable requirements <br />of Section 6002 of the Solid Waste Disposal Act. <br />K. Domestic Preference for Procurements <br />As appropriate and to the extent consistent with law, the Recipient should, <br />to the greatest extent practicable under a Federal award, provide a <br />preference for the purchase, acquisition, or use of goods, products, or <br />materials produced in the United States (including but not limited to iron, <br />aluminum, steel, cement, and other manufactured products). The <br />requirements of this section must be included in all subcontracts including <br />all contracts for work or products under this Agreement. <br />ii. For purposes of this section: <br />a. "Produced in the United States" means, for iron and steel products, that <br />all manufacturing processes, from the initial melting stage through the <br />application of coatings, occurred in the United States. <br />b. "Manufactured products" means items and construction materials <br />composed in whole or in part of non-ferrous metals such as aluminum; <br />plastics and polymer -based products such as polyvinyl chloride pipe; <br />aggregates such as concrete; glass, including optical fiber; and lumber. <br />Recipient/Subrecipient AgreementLast Revised: 3.20.2023 Page 31 of 45 <br />291 <br />
