FWC Agreement No. Enter CFDA Number(s) <br />i. All iron and steel, manufactured products, and construction materials used <br />in the project must be produced in the United States. <br />ii. The BABA provision applies to all articles, materials, and supplies <br />consumed in, incorporated into, or affixed to an infrastructure project for <br />federal awards on or after May 14, 2022. <br />iii. All subcontractors, successors, or assignees to this Agreement will be held <br />to the same requirements as the original Parties to this Agreement. <br />iv. The BABA provision does not apply to tools, equipment, and supplies <br />brought to the construction site and removed at or before completion of <br />the infrastructure project. Nor does the BABA provision apply to equipment <br />and furnishings used at or within the finished infrastructure project but <br />are not an integral part of the structure or permanently affixed to the <br />infrastructure project. <br />P. Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment <br />Recipients and subrecipients are prohibited from obligating or expending loan or <br />grant funds to procure, obtain, extend or renew an agreement that utilizes <br />telecommunications equipment produced by Huawei Technologies Company or <br />ZTE Corporation (or any subsidiary or affiliate of such entities). <br />i. For the purpose of public safety, security of government facilities, physical <br />security surveillance of critical infrastructure, and other national security <br />purposes, video surveillance and telecommunications equipment produced <br />by Hytera Communications Corporation, Hangzhou Hikvision Digital <br />Technology Company, or Dahua Technology Company (or any subsidiary or <br />affiliate of such entities). <br />ii. Telecommunications or video surveillance services provided by such <br />entities or using such equipment. <br />iii. Telecommunications or video surveillance equipment or services produced <br />or provided by an entity that the Secretary of Defense, in consultation with <br />the Director of the National Intelligence or the Director of the Federal <br />Bureau of Investigation, reasonably believes to be an entity owned or <br />controlled by, or otherwise connected to, the government of a covered <br />foreign country. <br />Recipient/Subrecipient AgreementLast Revised: 3.20.2023 Page 33 of 45 <br />293 <br />
