The project was <br />located between Quay Dock Road and 63rd Street, east of US Highway 1, near <br />the Indian River Lagoon. The site was located within a particular flood hazard <br />area and fell within the 100 -year Base Flood Elevation of five (5) feet. <br />Mr. Lieske stated according to the Land Development Regulations Section <br />930.07(2)(i)l.a., a waiver would be necessary for the 10 -year and the 100 -year <br />flood storage balance requirements. The regulation also required an equal amount <br />of cut material for every fill material added without impacting the water by more <br />than one (1) foot. Failure to obtain these waivers could have an adverse effect on <br />the development. Former County Attorney Dylan Reingold had stated that if a <br />request was made for a waiver of the 10 -year regulation, a separate request must <br />be made for a waiver of the 100 -year regulation. <br />He discussed the FEMA flood plain guidelines and the County's participation in <br />the Community Rating System (CRS). This system helped residents purchase <br />flood insurance at lower rates. The County was audited every 3-5 years to <br />establish the CRS rating and the County's flood guidelines were recertified every <br />few years, with the next audit scheduled for 2024. <br />Chairman Adams and Mr. Lieske entered into a discussion regarding the potential <br />impact of granting waivers on the County's CRS points. Mr. Lieske stated that the <br />CRS points were unaffected by the number of waivers granted. The Stormwater <br />Division would address how the development would manage stormwater to <br />ensure it does not impact the adjacent homeowners. <br />Commissioner Moss sought and received the history of granting waivers and if <br />there were unexpected consequences by granting them. Mr. Lieske stated that <br />since 1991, when the Land Development regulations were developed, the County <br />had granted two waivers for subdivisions and one waiver for commercial <br />development. Further to his knowledge, there had not been any unexpected <br />consequences. Senior Civil Engineer Adam Heltemes specified that waivers for <br />Orchid Landing, previously known as Warren Way and Provence Bay, were <br />granted in 2005. Mr. Heltemes stated the current proposal ensured that any <br />waiver granted followed what had been approved on paper to ensure the waiver <br />was tied to the project and did not continue with the property if the project was <br />abandoned. <br />Commissioner Earman expressed concern regarding the filling of wetlands. In <br />response, Mr. Heltemes acknowledged the concern and stated that currently, it <br />was possible to mitigate for wetlands and still fill them.
