Boc, . 98 TAE 868 <br />development regulations. Pursuant to the specific land use <br />criteria for an ACLF, the proposed residential capacity of the <br />facility must be consistent with the Health and Rehabilitative <br />Services (HRS) license applied for by the applicant. Issuance <br />of the HRS license to operate is contingent upon HRS <br />inspection and approval of the constructed facility. Through <br />its permitting, inspection, and monitoring process, HRS will <br />ensure that its ACLF requirements are satisfied and that the <br />facility will be licensed for no more than 108 residents (in <br />accordance with the county's approval). <br />Staff has verified that the site plan application satisfies <br />all of the applicable specific land use criteria. <br />19. Concurrency: The applicant has chosen not to apply for an <br />initial concurrency certificate at this time and has recorded <br />a concurrency notice form. The notice states that no building <br />permit will be issued for all or any portion of the project <br />unless and until a concurrency certificate is issued for the <br />project. The notice is recorded in the public records in <br />order to alert any subsequent purchasers of the project or <br />portions of the project about the status of the _project's <br />concurrency requirements. With this notice, all concurrency <br />requirements related to the site plan have been satisfied. <br />RECOMMENDATION: <br />Based on the analysis performed, staff recommends that the Board of <br />County Commissioners grant special exception use approval for the <br />proposed adult congregate living facility for 108 residents. <br />Community Development Director Bob Keating presented staff's <br />recommendation for special exception use approval, noting that HRS <br />will see that this facility meets all license/permit requirements. <br />Chairman Adams opened the public hearing and asked if anyone <br />wished to be heard in this matter. <br />Don Wolverton, 630 15th Street, immediately adjacent to this <br />facility, was concerned about increased traffic on 15th Street <br />which is a short street that deadends at 6th Avenue. He urged the <br />Board to consider that impact before approving this request. <br />Director Keating stated that the 91 daily trips generated by <br />the ACLF use would be considerably less than those generated by a <br />multiple -family development, which had been the. prior designation <br />of this property. He felt this is a conservative estimate. <br />Todd Smith, design engineer for the project, clarified that <br />250 daily trips would have been generated by multiple -family <br />residential of this size at 10 units per acre. Originally, this <br />parcel of land existed as a subdivision for which the Commission <br />49 <br />AUGUST 20, 1996 <br />
