• <br />Ll <br />C1 <br />MODIFICATION TO <br />CONTRACT FOR INSTALLATION AND WARRANTY <br />OF LIVE OAKS <br />NO. SD -99-07-10-1-0 (99030155-002) <br />THIS CONTRACT, made and entered into this 2nd day of May <br />2000, by and between BEAZER HOMES CORP., a corporation existing under <br />the laws of the State of Tennessee, hereinafter referred to as "Developer," and <br />INDIAN RIVER COUNTY, a political subdivision of the State of Florida, by and <br />through its Board of County Commissioners hereinafter referred to as "County". <br />WITNESSETH: <br />WHEREAS, Developer and County entered into Contract for Installation <br />and Warranty of Live Oaks No. SD -99 -07 -10 -LO (99030155-002) on May 2, <br />2000, and <br />WHEREAS, paragraph 11 of that contract requires any modification to be <br />in writing, signed by authorized representatives of each party; and <br />WHEREAS, the parties wish to clarify the 60 -month monitoring period <br />specified in the contract; <br />NOW, THEREFORE, the parties hereby modify the contract to clarify that <br />the 60 -month monitoring period referenced in paragraph 9 of the contract shall <br />run from the installation of the live oaks, whether the installation occurs before or <br />on the deadline of May 2, 2001 in paragraph 1 of the contract. <br />1 <br />
