� � r <br />Mr. Chastain gave details on the attendance at the <br />informational meetings. He felt the majority of those with whom <br />staff met had a positive feeling about the project with a few <br />exceptions. He believed there was little opposition to the Phase <br />I project because the area is primarily residential, except along <br />CR -512 and a few unplatted parcels. <br />Mr. Chastain advised that 85 scrub lots slated for purchase <br />with bond funds are located within the project area and that a <br />decision needed to be made concerning them. <br />The following memo dated August 26, 1996, was also considered. <br />TO: James E. O'Brien, Assistant County Attorney < " <br />DATE: August 26, 1996 <br />RE: SPECIAL ASSESSMENT - SCRUB JAY LOTS <br />You have asked this office through the Director of Budget whether <br />Land Acquisition Bond money may be used to pay for the special <br />assessment for water service to the area where the scrub jay lots are <br />located. <br />The lots were appraised without water services. Now that acquisition <br />and water service may be imminent, the lots should be reappraised <br />showing water service. If the reappraisal shows an increase in the <br />value equal to or greater than the assessment then bond monies could be <br />used for acquisition. If the reappraisal shows an increase in value <br />less than the special assessment, then the County could purchase the <br />lots at over appraisal value and this over appraisal costs would be an <br />acquisition cost and also payable with bond monies. However, because <br />the purchase would be at over appraisal a super majority of the Board <br />of County Commissioners would have to approve the purchase and the <br />portion over appraisal would not be part of the amount reimbursable by <br />FCT. <br />If at the time of purchase of the lots, the water service project has not <br />been approved and hence no lien, then any future project and <br />assessment would be the General Fund responsibility and not bond <br />monies. <br />In response to Chairman Adams' request for someone to address <br />the scrub lot issue, Utility Services Director Terry Pinto advised <br />that the lots designated for scrub protection had been discussed at <br />staff level and staff had no alternative but to assess the lots. <br />He advised that the decision to develop or not develop the lots is <br />voluntary. When the assessment was formulated, staff was required <br />to send the assessment to the recorded lot owners. If the scrub <br />properties are not assessed, the cost of the project will have to <br />be distributed (increased) amongst the remaining properties. While <br />the Board could decide not to make water available in the scrub <br />project area, <br />that be done. <br />August 27, 1996 <br />Director Pinto advised that he would not recommend <br />17 <br />
