BOOK f`,a 947 <br />Under discussion, Chairman Adams thought the County's <br />settlement offer was quite generous. <br />County Attorney Vitunac advised that there were some disputes <br />as to timing with DER (Department of Environmental Regulation - now <br />Department of Environmental Protection) permits and location. The <br />County had placed the lien on the property to force the connection. <br />If the matter was pursued in court, he believed the lien would be <br />discounted substantially. If the County prevailed, it would then <br />become a cost of connection to the system and the owners would pass <br />it through to the residents of the mobile home park. By accepting <br />the $150,000 from the developer, however, it becomes the <br />developer's expense and will also be a credit against the future <br />water impact fees to be paid by the tenants. He recalled that when <br />the tenants were interested in buying the park, they were very <br />happy with the same offer made to them. <br />County Attorney Vitunac added that the lien was for base <br />facility and interest for the period the County said they should <br />have been connected, but were not. The developers had vehemently <br />contested the timing and the date. Rather than go to court, since <br />the tenants were trying to buy it, the County put the lien on and <br />waited. The County now needs to remove the lien. He believed the <br />County's offer to be in the public interest. <br />THE CHAIRMAN CALLED THE QUESTION and the motion <br />carried unanimously.
