River Boat Club Associates Partnership - Request for <br />Release of Cash Bond and Request for Authorization for <br />Satisfaction of Mortgage - River Boat Club Subdivision <br />The Board reviewed a Memorandum of August 27, 1996: <br />TO: The Board of County Commissioners <br />FROM: 4S e_ William G. Collins II - Deputy County Attorney <br />DATE: August 27, 1996 <br />SUBJECT: Request for Release of Cash Bond Posted -by River Boat Club <br />Associates Partnership and Request for Authorization for a <br />Satisfaction of Mortgage to be Executed in Regard to The River <br />Boat Club Subdivision <br />River Boat Club Associates Partnership posted a $1,207.50 cash bond with <br />Indian River County to guaranty construction of certain required improvements <br />for The River Boat Club Subdivision. All the required improvements are now <br />complete and an inspection of the improvements has been made by the County. <br />By memorandum dated August 12, 1996, the County Engineer has indicated the <br />completion and satisfaction of those improvements and has recommended the <br />return of the cash bond to the developer. <br />River Boat Club Associates Partnership, the developer of The River Boat Club <br />Subdivision, also entered into a Warranty, Guaranty and Maintenance <br />Agreement, and Bill of Sale for Required Improvements to guaranty the public <br />improvements for one year and, as security for the warranty period, the <br />County is holding a first mortgage on Lot 16 of The River Boat Subdivision. <br />The 1 -year warranty period has now expired and a Satisfaction of Mortgage is <br />required to release Lot 16 of The River Boat Subdivision from the mortgage. <br />REOUESTED ACTION• <br />Approve the attached resolution and authorize the Chairman to execute same, <br />giving authorization to the Office of Management and Budget to return the <br />$1,207.50 cash bond with interest to River Boat Club Associates Partnership, <br />and to authorize the Chairman to execute the attached Satisfaction of <br />Mortgage with respect to Lot 16 of The River Boat Club Subdivision prior to <br />it being recorded in the Public,Records of Indian River County, Florida. <br />SEPTEMBER 3, 1996 <br />10 <br />
