�1 1 <br />Contract 099H235 <br />Amendment #1 31 <br />FIRST AMENDMENT TO THE AGREEMENT BETWEEN <br />THE STJOHNS RIVER WATER MANAGEMENT DISTRICT <br />AND INDIAN RIVER COUNTY <br />FOR THE STORMWATER MANAGEMENT COST -SHARE. AGREEMENT <br />THIS AMENDMENT is entered into this 1 St day of August , 2000, by and <br />between the GOVERNING BOARD of the ST. JOHNS RIVER WATER MANAGEMENT <br />DISTRICT, whose mailing address is Post Office Box 1429, Palatka, Florida 32178-1429 <br />("DISTRICT'), and INDIAN RIVER COUNTY ("ENTITY"), whose address is 1840 25th Street, <br />Vero Beach, Florida 32960. <br />WHEREAS, DISTRICT and ENTITY entered into an Agreement on April 6, 199'9, to assist <br />Indian River County in the implementation of the Roseland area stormwater detention lakes. <br />WHEREAS, DISTRICT and 'ENTITY desire to modify the Agreement. <br />NOW, THEREFORE, in consideration of the mutual covenants contained herein and for <br />other good and valuable consideration, DISTRICT and ENTITY hereby agree to the following <br />amendments: <br />1. Item 3 The DISTRICT shall: Paragraph B shall he deleted and replaced with the <br />following: <br />"Obligate moneys to fund a portion of the stormwater management projects in an amount <br />not to exceed $50,000, or 13% of the total cost of the Gifford Project; and an amount not to <br />exceed $185,000, or 32% of the Roseland Project. If, upon completion of all the tasks <br />identified for reimbursement, the ENTITY's actual expenditure for the tasks) identified for <br />reimbursement is less than originally projected in Project Budget, Exhibit B-1, attached, the <br />DISTRICT's obligation shall be reduced proportionately." <br />2. Item 4 The ENTITY shall: Paragraph B shall be deleted and replaced with the following: <br />"Obligate moneys to fund these two stormwater management projects. ENTITY shall <br />provide a minimum amount of 87% of the funding for the Gifford Project; and a minimum <br />amount of 680 of the funding for the Roseland Project, and agrees to provide funding for <br />any other costs above amount budgeted; if any, required to complete this project." <br />3. Item 7: shall be amended as follows: <br />I'he Completion date of the Agreement shall he October 6, 2002." <br />DISTRICT and ENTITY agree that all other terms and conditions o; the original Agreement <br />are hereby ratified and continue in full farce and effect. <br />Page I of 4 <br />
