For all <br />events booked withi 30 days, or les., e 25% reservationiIi posit will become non-refundable. <br />14. Damage deposit pay ent must be p�id'in the form of cashc r check (with appropriate ID). Credit cards are <br />accepted for payment of the Damage Deos►t and may be use to pay the facility Reservation fee. Indian River <br />County accepts VISA., MasterCard a d Escover as fomes of credit card payment. <br />15. The serving and consumption of ?alcoholic beveragesstrictly prohibited under this Reservation <br />Aareement/Aereem6nt and erounlds ifor dismissal of `thee event including the loss of your Damage <br />16. There shall be no Jmbline on the I relmises. i <br />17. Undisclosed or un rmitted activities or hours shall void his Agreement. The Event shall be used for no <br />other purpose whatso ver, unless prig written approval is ruested in writing by Applicant and given by the <br />County which approval shall be subject to availability b`�t not be unreasonably withheld, conditioned, or <br />delayed so long as su,-h request is soli m'4ted at least 90 da} rior to the beginning of the License Duration. <br />18. The Dama a De osit will be refund e u on staffs revi& of the condition of the rented area and will <br />not be applied to th4 final balance of the Reservation. Thi Damage Deposit refund will be issued to the <br />Renter, unless the Dlimaze Deposit! vas paid by check, iri4hich case, the check will be issued and mailed <br />to the person who issued the check] The check will be mailed within Chir 30 business days. <br />19. Applicant's failure to make any of th p yments required Ar in a timely manner shall constitute a <br />material breach ands iall result in the irr mediate terminatiI of this License Agreement. All fees, costs, and <br />expenses, including, ithout limitation, ttorney's fees, ine� ed by the County in the collection of any <br />payment due hereon r shall be reim ur ed by Applicant. <br />20. Applicant aclmowlec ges that the C un may immediatily terminate the Event if the National Weather <br />Service issues a sevei D weather warn, g,.0 r imminent sever weather conditions develop in the area indicating <br />a risk to public safety, or a state of c ►criency has been dcla� ed. Applicant hereby waives any rights and all <br />claims for damages a jainst the Coun� t at may result from t e exercise of the rights reserved herein. <br />21. The County and its o icers, agents a I d mployees engaged il 1 the operation and maintenance of the <br />Premises reserve the 'ght to enter upon nd to have free access to the Premises at any and all times, which <br />reservation is hereby cknowledged Ind agreed to by Applc nt. <br />i <br />22. Animals will not be ermitted onto t e it Center property g an event unless they are considered a <br />Service Animal. The Americans witD}}sabilities Act (AICA 2010 Regulations define a service animal as <br />"any dog that is individually trained o db work or perform ks for the benefit of an individual with a <br />disability, including e physical, sensory, psychiatric, intell 0 al, or other mental disability. Other species of <br />animals, whether wil or domestic, I in d or untrained, ar� of service animals for the purposes of this <br />definition." C.F.R. § 35.104 and § 3 .104 (2010).
