Titkanich, Jr., County Administrator <br />Kristin Daniels, Director, Office of Management and Budget <br />Jennifer Hyde, Purchasing Manager <br />FROM: Shelby Ball, Purchasing Specialist <br />SUBJECT: Second Extensions and Amendments to Disaster Debris Management <br />Services Agreements <br />BACKGROUND: <br />On April 21, 2020, the Board awarded RFP 2020025 for Disaster Debris Management Services as <br />may be needed to respond to catastrophic events, such as tropical storms, hurricanes, or <br />tornadoes, to Ceres Environmental Services, Inc. (primary), and CrowderGulf Joint Venture, Inc. <br />(secondary). The term of the award was 24 months, with two additional 24 -month terms available. <br />On March 8, 2022, the Board approved the First Extensions and Amendments to the Agreements, <br />which expire on April 20, 2024. Both contractors have agreed to execute the second extensions, <br />which will be effective from April 21, 2024, through April 20, 2026. <br />Changes made effective to the Code of Federal Regulations during the initial term of the <br />agreement require the incorporation of additional clauses to the agreements. <br />Article 4 of the Agreement allows contractors to submit written notification of its request for a <br />requested price increase, based on the CPI Index (South) for the preceding 12 -month period of <br />December to December. CrowderGulf did not request an increase to pricing. Ceres has submitted <br />a request to increase their pricing by 2%, plus a 7.5% increase they believed had been requested <br />and approved in 2022. Neither the County, nor Ceres could find evidence that any request to <br />increase price was submitted by Ceres to the County, and the first extension and amendment did <br />not memorialize any change to contract price. Staff has negotiated a 9.27% increase with Ceres, <br />which is considerably lower than the 19.5% potential increase the contractor could have requested <br />thus far. <br />mjruninir;- <br />Expenses incurred for work under these agreements are anticipated to be funded through FEMA's <br />reimbursement of CAT A debris expenses. <br />156 <br />
