The BABA provision does not apply to tools, equipment, and supplies brought to the construction <br />site and removed at or before completion of the infrastructure project. Nor does the BABA <br />provision apply to equipment and furnishings used at or within the finished infrastructure project <br />but are not an integral part of the structure or permanently affixed to the infrastructure project. <br />P. Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment <br />Recipients and subrecipients are prohibited from obligating or expending loan or grant funds to procure, <br />obtain, extend or renew an agreement that utilizes telecommunications equipment produced by Huawei <br />Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities). <br />i. For the purpose of public safety, security of government facilities, physical security surveillance of <br />critical infrastructure, and other national security purposes, video surveillance and <br />telecommunications equipment produced by Hytera Communications Corporation, Hangzhou <br />Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or <br />affiliate of such entities). <br />ii. Telecommunications or video surveillance services provided by such entities or using such <br />equipment. <br />iii. Telecommunications or video surveillance equipment or services produced or provided by an <br />entity that the Secretary of Defense, in consultation with the Director of the National Intelligence <br />or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned <br />or controlled by, or otherwise connected to, the government of a covered foreign country. <br />Section 25. AGREEMENT -RELATED PROCUREMENT. <br />A. PRIDE. <br />In accordance with Section 946.515(6), F.S., if a product or service required for the performance of this <br />Contract is certified by or is available from Prison Rehabilitative Industries and Diversified Enterprises, <br />Inc. (PRIDE) and has been approved in accordance with Subsection 946.515(2), F.S., the following <br />statement applies: <br />It is expressly understood and agreed that any articles which are the subject of, or required to carry out, <br />this contract shall be purchased from [PRIDE] in the same manner and under the same procedures set <br />forth in Subsections 946.515(2) and (4), F.S.; and for purposes of this contract the person, firm or other <br />business entity carrying out the provisions of this contract shall be deemed to be substituted for this <br />agency insofar as dealings with such corporation are concerned. <br />The above clause is not applicable to subcontractors unless otherwise required by law. Additional <br />information about PRIDE and the products it offers is available at htip://www.nride-ent=rises.orQ. <br />B. Respect of Florida. <br />In accordance with Subsection 413.036(3), F.S., if a product or service required for the performance of this <br />Contract is on the procurement list established pursuant to Subsection 413.035(2), F.S., the following <br />statement applies: <br />It is expressly understood and agreed that any articles that are the subject of, or required to carry out, <br />this contract shall be purchased from a nonprofit agency for the blind or for the severely handicapped <br />that is qualified pursuant to Chapter 413, F.S., in the same manner and under the same procedures set <br />Recipient/Subrecipient Agreement Last Revised: 3.20.2023 Page 22 of 29 <br />
