DF.F]QVITi4}11t5 <br />Whcrever used in these General Conditions or in the other Contract Documents the following terms have <br />the meanings indicated which are applicable to both the singular and plural thereof: <br />rfddenda - Written or graphic instructions issued prior to the opening of Bids which clarify, correct or change <br />the bidding documents or the Contract Documents. <br />Agreement - The written agreement between OWNER and CONTRACTOR covering the Work to be <br />performed; other Contract Documents are attached to the Agreement and made a part thereof as provided <br />therein. <br />Application for Payment - The farm accepted by ENGINEER which is to be used by CONTRACTOR in <br />requesting progress or final payments and which is to include such supporting documentation as is required <br />by the Contract Documents. <br />Approved Equal - A substitute product equal to or better than the brand name product as specified and <br />permitted to be used in this Project only when approved by the ENGINEER. <br />Bidder Any person, firm, or corporation submitting a Bid Proposal for the Project. <br />Change Order - A document recommended by ENGINEER, which is signed by CONTRACTOR and <br />OWNER and authorizes an addition, deletion or revision in the Work or an adjustment in the Contract Price <br />or the Contract Time, issued on or after the Effective Date of the Agreement. <br />Contract - The agreement executed by the OWNER and Bidder given the Award for the Project, including <br />all Contract Documents. <br />Contract Documents - Advertisement for Bids, Instructions to Bidders, Bid Bond, Bid Proposal, Statement <br />on Public Entity Crimes, Sworn Statement under the Florida Trench Safety Act, Information Required of <br />Bidders, Agreement, Certificate of Insurance, Payment Bond, Performance Bond. General Conditions, <br />Supplementary Conditions, Technical Specifications, Drawings, Appendix, Geotechnical Report, Florida <br />Department of "Transportation (FDOT) Standard Specification for Road and Bridge Construction (1996), <br />FDOT Roadway and Traffic Design Standards (1994), American Water Works Association Standards, <br />American National Standards Institute, American Society for'resting and Materials Standards and American <br />Association of State Highway and Transportation Officials, Standard Building Cade (1997), together with <br />all Addenda and Change Orders issued with respect thereto. <br />Contract Price -The moneys payable by OWNER to CONTRACTOR under the Contract Documents as <br />stated in the Agreement (subject to the provisions of paragraph 11.9 in the case of Unit Price Work.) <br />Contract Rine - The number of days (computed as provided in paragraphs 17.2 and 17.3) or the date stated <br />in the Agreement for the completion of the Work. <br />Contractor - The person, firm or corporation with whom OWNER has entered into the Agreement, <br />Defective - An adjective which when modifying the word Work refers to Work that is unsatisfactory, faulty <br />or deficient, or does not conform to the Contract Documents, or does not ineet the requirements of any <br />inspection, reference standard, test or approval referred to in the Contract Documents, or has been damaged <br />prior to ENGINEER'S recommendation of final payment (unless responsibil.y for the protection thereof <br />has been assumed by OWNER at Substantial Completion in accordance with paragraph 14.8 or 14.14). <br />Drawings - The drawings which show the character and scope of the Work to be perfotmncd and which have <br />GENERAL CONDITIONS <br />QC <br />
