i <br />• <br />otherwise provided in the Supplementary Conditions, neither OWNER nor ENGINEER shall have <br />any authority or responsibility in respect of such coordination. <br />8.1 OWNER shall issue all communications to CONTRACTOR through ENGINEER. <br />8.2 In case of termination of the employment of ENGINEER, OWNER shaii appoint an engineer against <br />whom CONTRACTOR makes no reasonable objection, whose status tinder the Contract Documents <br />shall be that of the former ENGINEER. Any dispute in connection with such appointment shall be <br />subject to arbitration. <br />8.3 OWNER shall furnish the data required of OWNER under the Contract Documents promptly and <br />shall make payments to CONTRACTOR promptly after they are due as provided in paragraphs 14.4 <br />and 14.13. <br />8.4 OWNER's duties in respect of providing lands and easements and providing engineering surveys <br />to establish reference points are set forth in paragraphs 4.1 and 4.14. Paragraph 4.2 refers to <br />OWNER's identifying and making available to CONTRACTOR copies of reports of explorations <br />and tests of subsurface conditions at the site and in existing strictures which have been utilized by <br />ENGINEER in preparing the Drawings and Specifications. <br />8.5 OWNER's responsibilities in respect of purchasing and maintaining liability and property insurance <br />are set fortis in paragraphs 5.5 and 3.12. <br />8.6 OWNER is obligated to execute Change Orders as indicated in paragraph 10A. <br />8.7 OWNER's responsibility in respect of certain inspections, tests and approvals is set forth in <br />paragraph 13.4. <br />8.8 In connection with OWNER's right to stop Work or suspend Work, see paragraphs 13.10, and 15.1. <br />Paragraph 15.2 deals with OWNER's right to terminate services of CONTRACTOR under certain <br />circumstances. <br />ARTICLE 9 --ENGINEER'S STA'['[I$)[)ITINC CON$TRUCIM <br />OWNER's Representative., <br />9.1 ENGINEER will be OWNER's representative (luring the construction period. The duties and <br />responsibilities and the limitations of authority of ENGINEER as OWNER's representative during <br />construction are set forth in the Contract Documents and shall not be extended without written <br />consent of OWNER and ENGINEER. <br />Visits to Site. <br />9.2 ENGINEER will make visits to the site at intervals appropriate to the various stages of construction <br />to observe the progress and quality of the executed Work and to determine, in general, if the Work <br />is proceeding in accordance with the Contract Documents. ENGINEER will not be required to make <br />exhaustive or continuous onsite inspections to check the duality or quantity of the Work. <br />ENGINEER's efforts will be directed toward providing for OWNER a greater degree of confidence <br />that the completed Work will conform to the Contract Documents. On the basis of such visits and <br />on-site observations as all experienced and qualified design professional, ENGINEER will keep <br />OWNER informed of the progress of the Work and will endeavor to guard OWNER against defee ts <br />GENERAL CONDITIONS <br />CC - 1�0 <br />
