C-] <br />and Party B agree to arbitrate. <br />16.6 <br />The CONTRACTOR shall carry on the Work and maintain the progress schedule during any <br />arbitration proceedings, unless otherwise mutually agreed in writing. <br />16.7 <br />The Florida Rules of Civil Procedure pertaining to discovery shall apply to both parties during <br />arbitration, and, at the OWNER's sole option, any and all arbitration arising; out of or relating to any <br />of the Contract Documents or any breach thereof shall include by consolidation, joinder, or joint <br />filing any additional person or entity not a party to this Agreement to the extent necessary for the <br />final resolution of the matter in controversy. <br />16.5 <br />At least one of the members of the arbitration panel must be an attorney Licensed to practice law in <br />the State of Florida. <br />16.9 <br />The surety shall be bound by the arbitration award to the some extent as the CONTRACTOR is <br />bound. <br />16.10 <br />The arbitration panel shall submit a written opinion with findings of fact and conclusions of law <br />stating the basis for the decision made, and including an award of arbitration that may be confirmed <br />by a court of competent jurisdiction, <br />16.1 l Unless OWNER agrees to the contrary, the location of any and all arbitration proceedings shall be <br />in the county in which the Project is located. <br />ARTICL.F. 17 - MisCFI.I.ANFC111S <br />Giving Notice: <br />17.1 Whenever any provision of the Contract Documents requires the giving of written notice, it will be <br />deemed to have been validly given ifdel ivered in person to the individual or to a member of the firm <br />or to an offrcer of the corporation for whom it is intended, or if delivered at or sent by registered or <br />certified mail, postage prepaid, to the last business address known to the giver of the notice. <br />Computation of Time: <br />17.2 When any period of time n referred to in the Contract Documents by days, it will be computed to <br />exclude the first and include the last day of such period, If the last day of any such period falls on <br />a Saturday or Sunday or on a day made a legal holiday by the law of the applicable jurisdiction, such <br />day will be omitted from the computation. <br />17.3 A calendar day of twenty-four (24) hours measured from midnight to the next midnight shall <br />constitute a day. <br />General: <br />17.4 Should OWNER or CONTRACTOR suffer injury or damage to person or property because of any <br />error, omission or act of the other party or of any of the other party's employees or agents or others <br />for whose acts the other party is legally liable, claim will be made in writing to the other party within <br />a reasonable time of the first observance of such injury or damage. The provisions of this paragraph <br />17.4 shall not be construed as a substitute for or a waiver of the provisions of any app] icable statute <br />of limitations or repose, <br />17.5 The duties and obligations imposed by these General Conditions and the rights and remedies <br />available hereunder to the patties hereto, and, in particular but without limitation, the warranties, <br />GF,NERAL CONDMONS <br />4C - 36 <br />
