i i SUPPLEMENTARY CONDITIONS TO GENERAL CONDITIONS A. introd :action These Supplementary Conditions amend or supplement the General Conditions (GC) of the Construction Contract and other provisions of the Contract Documents as indicated below. All provisions which arc not so amended or supplemented remain in full force and effect. U-001 M J 3. No forfeiture due to delay shall be made because of any delays in the completion of the f work due to unforeseeable causes beyond the control and without the fault or negligence of the CONTRACTOR (including but not restricted to Acts of God or of the public enemy, acts of the government, acts of the OWNER, or acts of another CONfRACfOR in the performance of a contract with the OWNER, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes and unusually severe weather or delays of subcontractors due to such causes or delays caused by the failure of the OWNER or the owner of a utility to provide for removal or relocation of existing utility facilities). Any such delays shall not entitle the CONTRACTOR to any additional compensation. The sole remedy of the CONTRACTOR shall be an extension of time obtained in accordance with this section. 2. The CONTRACTOR shall, within five days from the beginning of any such delay, notify the OWNER in writing of the cause of delay, whereupon the OWNER shall ascertain the facts and extent of the delay and extend the time for completing the work if, in his judgment, the findings of fact justify such an extension, and his findings of facts thereon shall be final and conclusive. 1. As set forth in paragraph 6.15 of the GC, the OW —R has obtained the following permits: a. IRC - Land Clearing, Tree Removal and Wetland Resource Permit b. SJRWMD - Stormwater Permit C. ACOE Wetland Filling Permit 2. The CONTRACTOR shall obtain and pay for all other required permits and licenses. The CONTRACTOR shall provide copies of these permits to the OWNER and Engineer and shall comply with all conditions contained in the permits at no extra cost to the OWNER, 3. The CONTRACTOR shall be familiar with all permit requirements during construction and shall be responsible for complying with these requirements. The cost of this effort shall be included in the pay item which the work is most closely associated with. 4. The CONTRACTOR shall comply with the requirements of the "Indigo Snake Protection Program" by posting the approved notices and instructing all personnel on proper procedures to report a snake siting, 5. If dewatering is required, the CONTRACTOR shall coordinate with the St. Johns River Water Management District regarding the applicable rules and regulations.
