i <br />i <br />SUPPLEMENTARY CONDITIONS TO GENERAL CONDITIONS <br />A. introd :action <br />These Supplementary Conditions amend or supplement the General Conditions (GC) of the <br />Construction Contract and other provisions of the Contract Documents as indicated below. All <br />provisions which arc not so amended or supplemented remain in full force and effect. <br />U-001 M <br />J 3. No forfeiture due to delay shall be made because of any delays in the completion of the <br />f work due to unforeseeable causes beyond the control and without the fault or negligence of <br />the CONTRACTOR (including but not restricted to Acts of God or of the public enemy, acts <br />of the government, acts of the OWNER, or acts of another CONfRACfOR in the <br />performance of a contract with the OWNER, fires, floods, epidemics, quarantine <br />restrictions, strikes, freight embargoes and unusually severe weather or delays of <br />subcontractors due to such causes or delays caused by the failure of the OWNER or the <br />owner of a utility to provide for removal or relocation of existing utility facilities). Any <br />such delays shall not entitle the CONTRACTOR to any additional compensation. The sole <br />remedy of the CONTRACTOR shall be an extension of time obtained in accordance with <br />this section. <br />2. The CONTRACTOR shall, within five days from the beginning of any such delay, notify <br />the OWNER in writing of the cause of delay, whereupon the OWNER shall ascertain the <br />facts and extent of the delay and extend the time for completing the work if, in his <br />judgment, the findings of fact justify such an extension, and his findings of facts thereon <br />shall be final and conclusive. <br />1. As set forth in paragraph 6.15 of the GC, the OW —R has obtained the following permits: <br />a. IRC - Land Clearing, Tree Removal and Wetland Resource Permit <br />b. SJRWMD - Stormwater Permit <br />C. ACOE Wetland Filling Permit <br />2. The CONTRACTOR shall obtain and pay for all other required permits and licenses. The <br />CONTRACTOR shall provide copies of these permits to the OWNER and Engineer and <br />shall comply with all conditions contained in the permits at no extra cost to the OWNER, <br />3. The CONTRACTOR shall be familiar with all permit requirements during construction and <br />shall be responsible for complying with these requirements. The cost of this effort shall be <br />included in the pay item which the work is most closely associated with. <br />4. The CONTRACTOR shall comply with the requirements of the "Indigo Snake Protection <br />Program" by posting the approved notices and instructing all personnel on proper <br />procedures to report a snake siting, <br />5. If dewatering is required, the CONTRACTOR shall coordinate with the St. Johns River <br />Water Management District regarding the applicable rules and regulations. If a dewatering <br />permit is required, the contractor shall prepare an application to the District and pay any fee, <br />SUPPLEMENTARY CONDITIONS <br />SC - 1 <br />
