<br />Solid Waste and Recyclables Franchise Agreement
<br />method for collecting these items is with a grapple truck. Grapple trucks have hydraulic knuckle booms, tipped with a
<br />clamshell bucket. The grapple loader is mounted on the frame with a claw-like device to grab the waste and deposit it in
<br />a rear box mounted on the truck chassis.
<br />Collection shall mean the process of picking up, transporting, and dropping off Residential Waste, Commercial Waste
<br />and Disaster Debris at the Designated Disposal Site or Designated RMFP, or the process of picking up, transporting and
<br />dropping off Exempt Materials.
<br />Collection Service shall reference all services provided to collect materials pursuant to this Agreement (i.e., Commercial
<br />Collection Service, Residential Collection Service, and Residential Recycling Collection Service).
<br />Commencement Date shall mean October 1, 2025, the date services pursuant to the Agreement shall commence.
<br />Commercial Collection Service shall mean the collection of Solid Waste within the Solid Waste Franchise Area from
<br />Commercial Properties and Multi -Family or Residential Units choosing not to have Curbside Residential Collection Service,
<br />and delivery of Solid Waste to the Designated Facility.
<br />Commercial Containers shall mean any container including, but not limited to dumpster, Roll Off, or compaction
<br />equipment approved by the Contract Manager to be used for the collection of Solid Waste from any Commercial
<br />Customer utilizing dumpster, Roll Off, or compaction Commercial Collection Service.
<br />Commercial Customers shall mean any person receiving Commercial Collection Service.
<br />Commercial Property shall mean property or properties zoned or used for commercial or industrial uses or used by an
<br />entity exempt from taxation under s. 501(c)(3) of the Internal Revenue Code, and excludes property or properties zoned
<br />or used for single-family residential or multi -family residential uses.
<br />Commercial Supplemental Collection Services shall mean services provided by Franchisee to Commercial Customers
<br />which are not included in the Commercial Collection Service Rate including, but not limited to extra or special collection,
<br />gate service, roll-out service, container modification, or locking devices.
<br />Construction and Demolition or C&D shall mean that as defined in section 403.703, F.S. as amended and provided here:
<br />Discarded materials generally considered to be not water-soluble and nonhazardous in nature, including, but not limited
<br />to, steel, glass, brick, concrete, asphalt roofing material, pipe, gypsum wallboard, and lumber, from the construction or
<br />destruction of a structure as part of a construction or demolition project or from the renovation of a structure, and
<br />including rocks, soils, tree remains, trees, and other vegetative matter that normally results from land clearing or land
<br />development operations for a construction project, including such debris from construction of structures at a site remote
<br />from the construction or demolition project site. Mixing of Construction and Demolition with other types of Solid Waste
<br />will cause it to be classified as other than Construction and Demolition. The term also includes:
<br />a) Clean cardboard, paper, plastic, wood, and metal scraps from a construction project;
<br />b) Except as provided in s. 403.707(9)(1), Yard Waste and unpainted, nontreated wood scraps and wood pallets
<br />from sources other than construction or demolition projects;
<br />c) Scrap from manufacturing facilities which is the type of material generally used in construction projects and
<br />which would meet the definition of construction and demolition debris if it were generated as part of a
<br />construction or demolition project. This includes debris from the construction of manufactured homes and
<br />scrap shingles, wallboard, siding, concrete, and similar materials from industrial or
<br />d) De minimis amounts of other nonhazardous wastes that are generated at construction or destruction
<br />projects, provided such amounts are consistent with best management practices of the industry.
<br />Contamination shall mean any material placed into a Recycling Cart not included in the definition of Program Recyclables.
<br />Contamination shall also mean any material or combination of materials placed in either the Bulk Trash, C&D debris, or
<br />Yard Waste that does not meet their respective definitions. This definition shall also apply to the mixing of required
<br />separately collected loads of materials.
<br />Contract Manager shall mean the person designated by SWDD to act as the SWDD's representative during the term of
<br />this Agreement.
