Indian River County Solid Waste Disposal District <br />Solid Waste and Recyclables Franchise Agreement <br />Program Recyclables refers to Recyclable Materials or Recyclables included in the SWDD's Residential and Multi -Family <br />recycling program as defined in Exhibit 3. Program Recyclables include incidental amounts of rejects and non -designated <br />materials as can normally be expected as part of municipal recycling collection. <br />Rates shall mean the Board -approved amounts to be charged by Franchisee for Residential Collection Service, <br />Commercial Collection Service and Residential Recyclables Collection Service, or for Supplemental Collection Services. <br />Recyclable Materials or Recyclables shall mean those materials that are capable of being recycled and which would <br />otherwise be processed or disposed of as Solid Waste. This term encompasses Program Recyclables and Non -Program <br />Recyclables. <br />Recycling Cart shall mean Roll Cart, authorized, and approved by the Contract Manager for the collection of Program <br />Recyclables. <br />Recycling Container shall mean any container authorized and approved by the Contract Manager for the collection of <br />Recyclable Materials including but not limited to Recycling Cart and commercial recycling containers. <br />Recycling Franchise Area shall mean the specified area within the County, as defined in Exhibit 2, for which the Franchisee <br />is granted the right to collect Program Recyclables from Residential Customers. <br />Residential Collection Service shall mean Curbside collection of Solid Waste, including Bulk Trash and Yard Waste, from <br />individual Residential and Multi -Family Units, and delivery of collected materials to the Designated Facility. <br />Residential Customers shall mean any person residing in a Residential Unit receiving Residential Collection Service. <br />Residential Recyclables Collection Service shall mean the collection of Program Recyclables from Residential Unit by <br />Franchisee utilizing Recycling Cart or Container and delivered to the Designated Facility. <br />Residential Supplemental Collection Service shall mean any service provided by Franchisee that is not included in the <br />Residential Collection Services as set forth in Article 6.5. <br />Residential Unit shall mean each lot or parcel of land in the county that is improved for occupancy as a single-family <br />residence, duplex, triplex, or quadraplex, and any other residence, except a multiple dwelling unit. The term also includes <br />individually owned mobile or modular homes or trailers that: (1) have residential permanent license tags; (2) are erected <br />on a separate parcel of property; (3) are within a residential franchise area or a residential recyclables franchise area; and <br />(4) do not receive commercial service. <br />Roll Cart shall mean a wheeled container designed and intended to be used for automated collection service and meeting <br />specifications provided in Exhibit 5. <br />Route Load Ticket shall reference the internal ticket or tracking system of fleet utilized on a specific route. <br />Set Out shall mean an action, event, or instance comprised of the proper placement of Solid Waste, Program Recyclables, <br />Yard Waste, or Bulk Trash for Collection at Customer's premises, in accordance with County Code. <br />Single Stream Recycling refers to a recycling process that allows for comingled Recyclables, as defined in Exhibit 3, to be <br />collected. <br />Sludge shall mean that as defined in section 403.703, F.S. as amended and provided here: The accumulated solids, <br />residues, and precipitates generated as a result of waste treatment or processing, including wastewater treatment water <br />supply treatment or operation of an air pollution control facility, and mixed liquids and solids pumped from septic tanks, <br />grease traps, privies, or similar waste disposal appurtenances. <br />Solid Waste shall mean that as defined in section 403.703, F.S. as amended and provided here: Sludge unregulated under <br />the federal Clean Water Act or Clean Air Act, Sludge from a waste treatment works, water supply treatment plant, or air <br />pollution control facility, or garage, rubbish, refuse, special waste, or other discarded material, including solid, liquid, <br />semi-solid, or contained gaseous material resulting from domestic, industrial, commercial, mining, agricultural or <br />governmental operations. This term does not include Disaster Debris. <br />Solid Waste Franchise Area shall mean the specified area of the unincorporated County, as defined in Exhibit 2, for which <br />the Franchisee is granted the right to provide Residential Collection Service and Commercial Collection Service, as well <br />as Residential Supplemental Collection Service and Commercial Supplemental Collection Service. <br />
