BK: 2398 PG: 1618 <br />6. TERM: The term of this LEASE shall be for an initial thirty (30) year period <br />with one (1) option to renew for a twenty-five (25) year extension. Rent shall be one (1) dollar <br />per year and shall be paid in advance. Prepayment of the rent shall not affect in any way the <br />DISTRICT's rights under paragraph 24 below. The initial period shall commence on the date <br />of execution, and continue for a period of thirty (30) years. A second term of twenty-five (25) <br />years shall automatically commence absent written notice of termination by the DISTRICT or <br />the COUNTY at least ninety (90) days prior to the end of the initial term. <br />7. PURPOSE: COUNTY shall manage the Leased Premises solely to provide a <br />pathway or trail for passive public outdoor recreation. <br />8. QUIET ENJOYMENT AND RIGHT OF USE: COUNTY shall have the right of <br />ingress and egress to, from, and upon the Leased Premises for all purposes consistent with <br />paragraph 7 above that do not conflict with the DISTRICT's and the United States of America's <br />Dredge Material Management Program. <br />9. UNAUTHORIZED USE: COUNTY shall, through its agents and employees, <br />make every reasonable effort to prevent the unauthorized use of the Leased Premises or any <br />use thereof not in conformance with this LEASE. <br />10. ASSIGNMENT: This LEASE shall not be assigned, except as noted in <br />Paragraph 13, in whole or in part without the prior written consent of DISTRICT. Any <br />assignment made either in whole or in part without the prior written consent of DISTRICT shall <br />be void and without legal effect. <br />11. PLANS: The terms of this LEASE shall guide the passive recreational use <br />and the associated management of the Leased Premises in accordance with the schedule and <br />methodology stipulated below. <br />A.
