4.8 TI1e submission of a Bid will constitute an incontrovertible representation <br />by Bidder that Bidder has complied with every requirement of this Article <br />4, that without exception the Bid is premised upon pcrforn1ing and <br />furnishing the work required by the Cont ract Documents and such means, <br />methods, tech niques, sequences or procedures of construction as may be <br />indicated in or requi red by the Contract Documents, and that the Contract <br />Documents are sufficient in scope and detai l to indicate and convey <br />understanding o f all tenns and conditions for performance and furnishing <br />of the work. <br />5. INTERPRETATIONS AND ADDENDA <br />5.1 <br />5.2 <br />All questions about the meanings or intent of the Contract Documents arc <br />to be directed to the Utilities Department staff -Aaron J, Bowles. P,E .• <br />Environmental Engjncer with Indian Rjvcr County Utilities. <br />Interpretation or clarifications considered necessary by Engineer in <br />response to such questions will be issued by Addenda mailed or delivered <br />to all parties recorded by Engineer as having received the Bidding <br />Documents. Questions received less than ten days prior to the date for the <br />opening of Bids may not be answered. Only questions answered by <br />fonnal written Addenda w ill be binding. Ora l and other interpretations or <br />clarifications will be without legal effect. <br />Addenda may also be issued lo modify the Bidding Documents as deemed <br />advisable by Owner or Engineer. <br />BID SECURITY <br />6.1 <br />6.2 <br />Each Bid must be accompanied by Bid security made payable to Owner in <br />an amount of five percent of the Bidder's maxim um bid price and in the <br />fonn ofa certified or bank check or a Bid Bond issued by a s urely meet ing <br />the requirements of Paragraph 5.1 of the General Conditions. <br />The Bid security of the Successful Bidder will be retained until such <br />Bidder has exe.;utcd the Agreement and furnished the required Contract <br />securi ty, whereupon the Bid security will be ret urned . If the Successful <br />Bidder fails to execute and deliver the Agreement and furnish the required <br />Contract security within fifieen days aficr the Notice of Award, Owner <br />may annul the Notice of Award, and the Bid security of that Bidder will be <br />forfeited . <br />00100-4
