14,0 Rights Under Collective Bargaining Agreements <br />14.1 Employees who are covered under any collective bargaining agreement <br />between the District and any certified labor or,anization will have the <br />right to file a grievance regarding discipline imposed by the District as a <br />result of a violation of this Policy of said grievance is permitted to be filed <br />pursuant to the collective bargaining agreement and have the right to <br />appeal to the Public Employees Relations Commission or applicable court. <br />40 <br />15.0 Testing Pursuant to the Drug -Free Workplace Policy <br />15.1 Types of Testing. In order to maintain a drug or alcohol free work <br />environment and in accordance with Florida's Drug -Free Workplace <br />Program, Section 440. 101, et seq., Florida Statutes, as amended, and <br />j applicable administrative regulations, the District will test for the <br />j presence of drugs and/or alcohol in the following circumstances: <br />15.2 Pre-employment: All job applicants who have been offered a position of <br />employment in a safety -sensitive or special -risk positions must submit to <br />a drug andlor alcohol test before beginning employment or work with the <br />District. <br />i <br />
