Board of County Commissioners Meeting Minutes - Final <br />July 2, 2024 <br />election. The Resolution requested that a referendum be included on the upcoming <br />general election ballot on November 5, 2024. The Resolution also included the draft <br />referendum language and the notice requirements, which would be posted on the <br />Supervisor of Elections website, the County website, and in local publications. <br />A motion was made by Vice Chairman Flescher, seconded by Commissioner <br />Earman, to approve staffs recommendation and Resolution 2024-032, to call for a <br />referendum to be placed on the ballot of the General Election to be held on <br />November 5, 2024, to determine the electors of Indian River County, Florida <br />authorize amending Chapter 210 (Tourist Development Tax) of the Code of Indian <br />River County Florida, in order to impose an additional one per cent (1%) Tourist <br />Development Tax (the 5th cent); providing for a notice of the referendum <br />election; providing for the referendum election procedure; and providing for the <br />substance of the measure and the ballot title and summary. The motion passed <br />by the following vote: <br />Aye: 5 - Chairman Adams, Vice Chairman Flescher, Commissioner Earman, Commissioner <br />Moss, and Commissioner Lear <br />13.B. 24-0563 74th Avenue Property Exchange <br />Recommended Action: Staff recommends the Board of County Commissioners approve the Property <br />Exchange Agreement with Pellegrino and Michelle Barone, Oslo Road Agriculture, <br />LLC and Beale Holdings, Inc., approve the accompanying Resolution and authorize <br />the Chairman to execute the Agreement and Resolution together with authorizing the <br />signature of any deeds or document needed to complete the Exchange. <br />Attachments: Staff Report <br />Sketch of 74th Avenue <br />Property Exchange Agreement <br />Resolution <br />County Attorney Bill DeBraal explained that Florida Public Utilities, formerly Florida <br />City Gas, needed to install a gas line along 74th Avenue to supply natural gas to the <br />improvements being constructed at the County Landfill. Currently, there was <br />insufficient room to install the line without correcting the right-of-way configuration. <br />He expressed that to rectify the issue, the County proposed an even land exchange <br />without consideration for the affected property owners along 74th Avenue. The <br />affected property owners were Pellegrino and Michelle Barone (Barone), Oslo Road <br />Agriculture, LLC (Oslo), and Beale Holdings, Inc. (Beale). The Parties would <br />exchange Quit Claim Deeds as provided in the agreement for equal amounts of <br />property, and the County would record the deeds using the corrected legal <br />descriptions. <br />A motion was made by Commissioner Earman, seconded by Commissioner Moss, <br />to approve staffs recommendation and Resolution 2024-033, approving an <br />exchange of land with Pellegrino and Michelle Barone, Oslo Road Agriculture, <br />LLC and Beale Holdings, Inc.
